Walter’s Falls paralegal and husband file lies and false evidence in HRTO allegations..claims absolute privilege

Catherine Stewart, a Walter’s Falls Ontario paralegal and her husband, Paul Smith, who had Human Rights allegations (HRTO#17699-14) filed against them for violating tenants rights in 2014 used the system to file false testimony and false evidence to circumvent the allegations.

Catherine April Stewart, a licensed paralegal registered with the Law Society of Ontario, claims to be an eviction specialist and a landlord only advocate, but also runs a small property management company from a small cubicle office located at 117 Bayfield Street in Barrie Ontario.

As a property management company, Catherine Stewart refuses to allow any of the tenants she manages for her landlord only clients to enter her offices or to contact her over ANY tenant issues. A very strange rule for a legitimate property manager running a business representing clients to their tenants.

Catherine Stewart was present at a break and enter, ordered and committed by the paralegal, when she ordered a Barrie locksmith to enter a tenant’s residence without the legal right to do so which was witnessed by Barrie police officer’s Melanie Beard and officer Turner, who both refused to press charges against her when the tenant insisted they do so.

Read the police report from the officers and the many articles of violations that this paralegal commits, all in her self proclaimed status of being the “terminator”.

Being present and ordering the break and enter is another violation of the Law Society but the complaint that was filed in 2013 does not even appear anywhere on her profile to warn the public. David Cass headed that complaint off and refused to hear it even though the police reports were submitted to the law society to prove the claims.

Catherine Stewart is also known to use and sign the name April Stewart in the LTB hearings, which is not registered with the Law Society to practice law and then fails to honor any agreement she makes to make the tenant waste time and money going after the order she had agreed to and signed in the Landlord and tenant board.

Paralegals, according to the Law Society rules, are suppose to honor agreements they make in court which shows you what kind of paralegal Stewart really is when she states in LTB hearings, she is “a landlord representative” NOT LEGAL REPRESENTATIVE, as she does not fit the legal definition of a landlord in LTB and then signs a different name not registered with the law society and continuously fails to honor the agreements she makes.

The tenant filed complaints in the LTB courts for the break and enter after he vacated the unit but Catherine Stewart lied to the courts on the hearing day when Stewart sent another paralegal friend claiming to “Be out of the country September 21st 2013”. Witnesses can put Stewart in Meaford, Ontario when she was suppose to be in court to answer for the break and enter allegations.

Catherine Stewart’s husband, Paul Smith has been known to work for Stewart for over 10 years as a process server and other jobs his wife needed done for her property management company named landlord legal, including signing false documents for her to win cases for her landlord clients.

Paul Smith, an alleged retired OPP that has never been proven has been known to act, not only in the capacity of a process server for his paralegal wife, but has been known to enter tenants units every time they plan to evict a tenant for her landlord only clients and completely  photograph the tenants units before the eviction process begins in the LTB courts.

This photographing that Paul Smith does not only violates the Landlord and Tenant board rules but also violates the constitutional rights to privacy that is suppose to protect the tenants and their families.

Paralegal Catherine Stewart’s husband, Paul Smith has been known on several occasions to file false testimony and enter false evidence that is often signed by his paralegal wife or one of her friends in order to manipulate the courts.

When Catherine April Stewart of landlord legal enters this false testimony and false evidence, she is committing a crime, but gets away with it every time when she claims she has “ABSOLUTE PRIVILEGE” as a paralegal to do so.

Paul Smith has been known to illegally contact the Human Rights applicant during the time Smith and Stewart had been named in the Human Rights allegations and was presently before the Human Rights Tribunal in Toronto.

Although Paul Smith was directly named in the claim, he contacted the applicant directly which is against the law to harass a HRTO applicant and had made the applicant very concerned for his safety during the ongoing HRTO hearings.

Smith has also been known on numerous occasions to use statements, issued and signed as a private investigator when Paul Smith was not legally licensed to perform as such in Ontario. This alleged ex OPP officer has never had to prove he was a OPP officer or his legal private investigator status that he uses for his paralegal wife’s advantage in the Ontario courts.

Paul Smith even appeared on the stand as a witness in a civil case when he was not involved or even on the witness list that was given to the opposing party before the trial, as ordered by the judge hearing the case.

This pair has continued to get away with their manipulative tactics because Stewart is a paralegal and claims absolute privilege when defending a landlord client or in this case, Stewart and Smith when they were directly named in the Human Rights allegations.

There is definitely something wrong with our court system when a one year graduate gets a paralegal license and can lie, submit false evidence and continue to mock and manipulate the LTB boards and the the Ontario courts, all the while claiming to be a landlord rights advocate.

Many complaints have been filed with the Law Society over paralegal Catherine Stewart’s conduct, false testimony and her entering false evidence into courts, which is illegal in our court system, but if you look at her profile in the Law Society it will not even show one complaint. The Law Society uses its employees like David Cass, to head off any complaints that do come before them.

The Human Rights mediator hearing the allegations against Stewart and her husband for HRTO 16799-14, Mary Truemner stated in the courtroom that Stewart had definitely crossed the line and violated the tenants rights but had upset the applicant with some very ignorant comments in mediation and a very ridiculous proposal for a punishment that it made the applicant walk out of the hearing in disgust.

The Human Rights mediator hearing the case, Mary Truemner had stated Catherine Stewart was guilty and was suggesting that Stewart take an online Human Rights course and put up a Human Rights poster in her office as a remedy for her violations.

This very ridiculous remedy and other aspects of the Human Rights process will be discussed in full for the public to see that the registrar Richard Hennessy and the entire HRTO process in Ontario is a joke.

The HRTO mediator, Mary Truemner refused to hear the false evidence and false statement claims brought up by the applicant although the proper paperwork was submitted to the tribunal. The evidence and witnesses were concrete and could without a doubt prove that Catherine Stewart and her husband Paul Smith submitted the false statements and evidence into the hearings to protect their reputations.

The entire HRTO hearing will be discussed and many of the documents put online to show the public what one year graduates for a paralegal license like Catherine Stewart, will do in our Ontario courts and how they get away with it.

Many documents, statements, evidence submitted and emails received from the Human Rights tribunal of Ontario and the Law Society will be also be posted online to show what the Law Society does to protect paralegals and lawyers when legitimate complaints are filed with their office.

New complaints against Stewart have been filed with the Law Society and we will post all communication, documents and emails received concerning the complaints to further educate the public on how they protect dirty paralegals as long as they pay their fees to the society. You have to ask yourself why so many complaints that can be proven to be filed with them never get heard and never appear on their public profile that is accessible to the public. All we can say is PUBLIC BE AWARE OF THE DECEIT and the COVER UP PRACTICES OF THE LAW SOCIETY !!

Human Rights Tribunal of Ontario…What a joke.

After a long needed vacation and a trip across Canada, the writer is ready to discuss the Human Rights allegations and evidence that were brought up against a Walters Falls paralegal, Catherine April Stewart and her ex OPP officer boyfriend, Paul Smith, also of Walters Falls and can now be brought online to the attention of the public to see the injustice that is allowed in our Ontario court system from the Barrie Landlord and Tenant Board (LTB) to the Barrie Civil Courts all the way to the Human Rights Tribunal of Ontario (HRTO) and the neglect of the Law Society of Upper Canada (LSUC) to investigate the legitimate complaints filed by Canadian Citizens.

The HRTO allegations referred to are against paralegal & property manager Catherine April Stewart and ex OPP officer Paul Smith from HRTO file number 17699-14.You can request any of the documentation found here on our website from us at privacy violators or apply under the Freedom of Information with any of the file numbers given.

Along with Human Rights violations alleged and admitted to the wrong doing by the HRTO were allegations of false documents entered into evidence from Paul Smith which were notarized and witnessed by his paralegal girlfriend, Catherine Stewart who also represented the ex OPP officer and herself at the hearing until she admitted in April 2016 that, and I quote “she knows nothing of the Human Rights process” as we waited for her new lawyer, David Stashin to arrive at the hearing 2 1/2 hours later.

The false evidence allegations against Catherine Stewart and Paul Smith that was filed with the Human Rights Tribunal of Ontario had been ignored even though the applicant had filed the proper documents to HRTO stating the evidence did not exist at the North Toronto LTB office. The original evidence submitted as well as all the correspondence from the HRTO is to be uploaded for the public to see what paralegals can manipulate in our Ontario courts.

Walters Falls paralegal, Catherine April Stewart refused to proceed at the scheduled HRTO hearing until David Stashin arrived to take over after she herself submitted false evidence and testimony to which she herself signed with her Commissioner of Oaths Stamp for her own allegations against her and her ex OPP boyfriend Paul Smith.

BACKGROUND

Catherine April Stewart lives in Walters Falls and is a paralegal licensed by the Law Society of Upper Canada.
Catherine April Stewart is also a property manager running her paralegal and property management company from a small cubicle office from 117 Bayfield Street, Barrie Ontario.

The paralegal uses Landlord Legal inc for her paralegal services and signs Catherine April Stewart when working in this capacity.

The paralegal uses a property management company called Landlord Legal which is known to sign April Stewart when working in this capacity.

The property manager is a self proclaimed “LANDLORD RIGHTS ADVOCATE ONLY” and uses her Landlord Legal website to announce she is the self proclaimed”TERMINATOR”

The Landlord Legal website owned by Catherine Stewart is known to publicly threaten a tenant who had filed Human Rights allegations against her and her known boyfriend.

The property manager sends out “Do not Contact” and “Do not Trespass” letters without a letterhead making it look like it came from a legal office but was from the property manager capacity.

The paralegal is breaking rules of the Law Society by working in this conflict of interest positions as a paralegal and a property manager.

The paralegal is breaking rules of the Landlord and Tenant board when she represents landlords because she is a property manager but neglects to tell the opposing parties or the Landlord and Tenant Board she is also a paralegal and does not fit the definition of a “LANDORD” in the LTB courts but rather states she is a “Landlord Representative”.

Catherine April Stewart is known to sign April Stewart as a property manager, even with legal court documents when her legal name is Catherine April Stewart.

Catherine April Stewart is also known to use her ex OPP officer boyfriend, Paul Smith to do illegal searches of tenants residences and to sign her Commissioner of Oaths Stamp to testimony from her OPP alliance to further her clients interests.

The upcoming posts are going to be many, to put the truth online and the truth behind the corruption that is allowed in the Ontario Provincial Police force, the Barrie City Police force, the Barrie Civil Courts, the Ontario Human Rights Tribunal and the well known tactics used by many paralegals that are swept under the rug from the Law Society of Upper Canada.

Privacy Violators will post the evidence used, documents submitted, and the testimony and methods used by paralegals like Catherine April Stewart disguising themselves as property managers but practice Law openly, getting away with breaking the Rules, Laws and Rights set in place for people that honor the laws and rights of Ontario citizens.

Privacy Violators website has received many emails concerning paralegal / property manager Catherine Stewart and Toronto lawyer, David Strashin and will be discussing the tactics they have used in the past and the Law Society complaints that were filed against them and ignored by the LSUC.

Privacy Violators has also learned of other complaints filed with the LSUC against David Strashin and Catherine Stewart but there is no records of any of the complaints filed on their Law Society profiles, including the complaints filed July 2014 against Catherine Stewart of Landlord Legal inc misrepresenting herself as Landlord Legal, property manager.

New complaints to the Law Society of Upper Canada are being filed against these individuals and will be well watched by Privacy Violators and other websites that have expressed interested in these stories being ignored by the so called protectors of our rights.

The truth is the Human Rights Tribunal is the biggest joke in Ontario and the details to prove this will develop over the next few weeks on our website with all the documentation and communications that transpired for HRTO file numbers 17699-14 and Dykstra Bros Electric HRTO 16250-13.

The HRTO admits the applicant was not treated fairly and quite frankly the process was a joke and the evidence that will be uploaded is there for you to make your own judgement with the HRTO system in place.

Tell me that after reading all the HRTO claims and evidence  brought against Dykstra Bros Electric of Barrie and an ex OPP officer and his paralegal girlfriend, Catherine April Stewart disguised as a property manager.

I sincerely mean it when I say ” FUCK the corrupt police, FUCK the corrupt Ontario Court System and FUCK the corrupt Human Rights Tribunal and FUCK the corrupt Law Society of Upper Canada” it is a waste of your time.

In our opinion you are better off dealing with it your own way, it will be faster, cheaper and let them do the work of proving allegations against you for your actions.

She (Catherine April Stewart) was adamant. She was going to change the locks and has been doing this job for 13 years and can legally do so and not tell her how to do her job

For over 13 years this paralegal disguised as a property manager has been manipulating the Landlord and tenant Board hearings acting as both the property manager and a paralegal which ids not allowed under the LTB Act 2006. This does not fit the definition of a “Landlord” but she uses the term “Landlord representative” to deceive the LTB courts for the last 15 years when acting as a “Landlord only Rights Advocate” and evicting tenants for her landlord clients.

The Landlord and Tenant Board needs to be aware that Catherine A Stewart has been manipulating the courts and this needs to be addressed and stopped to protect Tenant rights.

We are the new Tenant Rights Advocate bringing the “Sharp Practice” frowned upon by the Law Society, which is a joke in itself, to the public spotlight.

Paralegals like Catherine April Stewart have been known to sign documents in LTB as April Stewart, which is not her legal name but then sign documents or Commissioner of Oath statements as Catherine April Stewart, her real given legal name.

The Law Society Rules say she is in conflict of interest using both capacities to manipulate the LTB board and the business act says she should be signing her legal name of Catherine A Stewart when a paralegal acting under her Landlord Legal inc company name.

This self proclaimed “Landlord Rights Only” Advocate is known to use locksmiths like the one owned by Paul Robertson of Barrie, Ontario, Central Lock and Key to break into tenants units because they have no physical address or brick and mortar store in which to serve legal papers to. If you are facing Paul Robertson, call their mobile number and have Paul or Cody come to a vehicle entry or key replacement and serve them when they show for the job. These cowards use many different ways to manipulate the police or the Court system as will be discussed in detail this year.

Catherine A Stewart is also known to use her boyfriend and ex OPP officer, Paul Smith of Walters Falls to enter units to photograph before evicting tenants and signing her Commissioner of Oaths Stamp to statements made by Paul Smith.

Paul Smith is known to act as a process server for the last ten years for his girlfriend and paralegal and is alleged to have given her false documents that she entered into Civil and Human rights Hearings that involved Landlord Legal directly. As an experienced process server Paul Smith should have known when he signed his name to Certificate of services that it is not legally filed until he files his signed statement with the Landlord and tenant Board.

Catherine April Stewart received a Certificate of Service from this ex OPP officer,home inspector,handyman,delivery boy and process server and entered it into evidence for a Human rights Hearing. The North Toronto LTB office had no record of the Certificate of Service he had given his girlfriend when she was defending Ralph Dykstra, Bill Dykstra and Donald Dykstra as a property manager and paralegal.

Paralegal / property Manager..Catherine April Stewart and her ex OPP boyfriend were also named in Human Rights allegations HRTO 17699-14 and the fraudulent documents were also submitted into evidence for their hearing as well as her Dykstra clients.

The Walters Falls resident and Barrie paralegal also refused to take a summons served to the ex cop and her boyfriend Paul Smith when the tenant filed LTB complaints against the “LANDLORD REPRESENTATIVE” as shown above.

 

You can not trust Landlord legal property manager or Landlord Legal inc paralegal to honor any court ordered agreement. The tenant had to take the paralegal and her clients to Barrie Civil court to retrieve an order issue by LTB Judge Sean Henry that was signed by April Stewart acting as the Dykstra’s Legal representative breaking the rules of the LTB Board when she did not fit the Landlord definition as defined by the LTB Act 2006.The order signed by Sean Henry was finally paid by William Dykstra

about 8 months after the order was agreed to by Catherine April Stewart proving you can not trust any of the Dykstra’s and Catherine Stewart no matter what they agree to and sign in court. Please be aware of these tactics constantly used by the Sharp Practices of Landlord Legal while she manipulates the LTB and the Ontario court Systems. Privacy Violators has received many emails of deals made by Catherine Stewart on behalf of her clients and many of the emails received state she did not pay the Court Orders. We will post the additional information we received when the personal Human Rights allegations against this paralegal and the ex OPP officer are discussed in full in our upcoming posts !!

The tenant will take this paralegal back to civil court to waste her time and the Civil courts time to retrieve the Court Ordered payments which she owes and thinks is a joke.

Another Sharp Practice used by abusive paralegals manipulating the legal system for their own gain or her clients gain in our opinion.

Catherine April Stewart has also failed to pay court ordered money when she and her Dykstra clients failed to appear in Barrie Civil Courts and had further lost two motions Catherine April Stewart had brought forward in the civil matters.

Ralph Dykstra of Dykstra Bros Electric loses publication ban motion for his examination hearing

The July 18th 2013 Landlord and Tenant Board undertaking to return last months rent to the Dykstra Bros Electric corporations tenant at 40 Ellen Street, Barrie, Ontario, upon vacancy, agreed to and signed by the Dykstra Bros representative, April Stewart of Landlord Legal, wasted a lot of time in the Barrie’s civil courts to retrieve the funds they refused to pay.

The order was originally mediated by then Orillia Legal clinic paralegal, Howard Tavroges (shown on right ), for the tenant and April Stewart of Landlord Legal, for Ralph Dykstra, William Dykstra and Donald Dykstra of Dykstra Bros Electric corporation.

William Dykstra represented the three brothers when Ralph Dykstra failed to show, claiming he was babysitting his grand children. The judge told paralegal Catherine Stewart that any of the Dykstra brothers could have attended being they were a corporation.

Catherine Stewart stated William Dykstra was out of the country and Ralph Dykstra was babysitting his grand children and could not be present for the examination that was pre-scheduled for Ralph Dykstra.

Howard Tavroges is alleged to have released confidential client information to paralegal C A Stewart while he was representing Landlord legal at Landlord and tenant Board hearings in barrie when she could not attend. Howard Tavroges is the paralegal that made the agreement and then Stewart failed to honor the agreement Landlord Legal had signed on behalf of Dykstra Bros Electric corporation.

  • Catherine Stewart is known to have given false information to the allegations filed with the Privacy Commissioner, Cristina Derenzis.
  • Landlord Legal has been known to threaten the Human Rights applicant and the TENANT ONLY RIGHTS advocate on her website.
  • Landlord Legal is known to contact the WSIB with false allegations, in hopes of harassing applicant further before the HRTO heard.

The public needs to know the laws concerning a paralegal who has an outside interest that is clearly in violation of the LSUC Rules and Regulations.

Unfortunately the complaints to get these issues investigated by the Law Society of Upper Canada, and have this paralegals license and actions reviewed to see if her actions were unbecoming of a paralegal, licensed through the Law Society will be heard after the Human rights allegations against Catherine A Stewart of Landlord legal, Catherine Stewart,ex OPP officer Paul Smith, Ralph Dykstra, Donald Dykstra and William Dykstra of Dykstra bros Electric.

In this writers opinion, this paralegal has blackened the reputation of paralegals and the Law society when she can manipulate and delay allegations and court procedures to save her little property management company and her conflict of interest paralegal business and personal reputation.

How can you be an advocate for rights when you abuse the system and violate other peoples rights to fight for Landlord clients ?

Why should this paralegal be allowed to hide behind a FALSE LEGAL legal status when she causes the issues and then hides in plain sight !!!

NO JUSTICE HERE only abuse of the system in our opinion. Send your comments and past interactions with Landlord legal and we will post to the NEW series continuing the paralegal Rules of conduct and business Rules of the Law Society and educate the public on the LSUC biggest mistake ever of allowing paralegals to work as a property management company.

Privacy Violators website is meant to warn you and educate the public of privacy violations and common rights that are being manipulated, ignored and trampled on because of the Canadian Legal system and the rules in place by the LSUC.

The Law Society of Canada should not have ignored and refused to investigate legitimate tenant complaints concerning landlord legal and manipulating methods used.

The Law Society has allowed another (3) three years of practice from Catherine Stewart and the same conduct unbecoming a paralegal complaints with the illegal break in allegations only because she claimed to have filed a SCC lawsuit in 2013 which April Stewart has done nothing to further. Another move to manipulate the system, abuse the system and delay the system as well as continue to severely harass the applicant who had filed the LSUC and Human rights allegations against her.

RULE 4: Advocacy

Outside Interests and Public Office
(4) A paralegal who engages in another profession, business, occupation or other outside interest or who holds public office concurrently with the provision of legal services, shall not allow the outside interest or public office to jeopardize the paralegal’s integrity, independence, or competence.
(5) A paralegal shall not allow involvement in an outside interest or public office to impair the exercise of his or her independent judgment on behalf of a client.

TRUST CONDITIONS

The Law Society has never been notified by paralegal Catherine Stewart, owner of Landlord legal inc, that allegations of illegal entry and illegal lock change had been brought against this paralegal Aug 2013 in Barrie LTB court, by the HR applicant and NONE of the accused showed for the hearing in Sept 2013.

The Law Society has not been notified by Landlord Legal inc that there has been pending Human Rights allegations against her legal firm since May 2014, and is now including a pending amendment for allegations of personal Human Rights breaches.


The Human Rights (HR) Applicant has a pending claim and allegedly added Catherine April Stewart as a pending personal Respondent to the alleged HR discrimination allegations brought up by an ex tenant of Dykstra Bros Electric of Barrie, Ontario.

cropped-cbk.jpgLegal documents were delivered Aug 11 2015 to the Respondents address on file for pending Human Rights proceedings against her clients and her legal firm, located at 117 Bayfield Street Barrie, Ontario when Catherine April Stewart tried AGAIN, to have the Applicant charged, for trespassing, or whatever the police would be willing to charge him with from her allegations !!

The Barrie Police officer in question, harassed the ex tenant further, when he called the Human Rights applicants, personal cell number.

The officer demanded that the Human Rights Applicant come into the police station, again for questioning, the Applicant told him “NO FUCKING WAY” and told him to stop calling the cell number, stop harassing him and talk to Mr Graves, the person who delivered the legal documents if he had a problem.The phone number was changed because of the constant harassment and demands of the Barrie police from these harassing and vexatious complaints.

Another false allegation to the Barrie police involved Detective Cst Steele, in which he called the Human Rights Applicants cell phone as well and THREATENED to have a WARRANT ISSUED if he did not turn himself into Barrie Police.

The allegations of Howard Tavroges and Catherine Stewart stemming from the HR applicant ATTENDING a public and open forum Landlord and tenant Board courtroom, to obtain FURTHER PROOF of Howards Tavroges conflict of interest allegations, releasing private and privileged information allegations, to Landlord Legal inc, while he had signed working as a representative for Orillia Legal Clinic,in a paralegal capacity for the ex tenant.
Tavroges signed the joint agreement with Ms Stewart on July 18th 2013 for an LTB Order, which she made the tenant fight her firm in Superior Court to retrieve monies owed, while Mr Tavroges had been or was representing Landlord Legal inc, in LTB matters at the same time legal proceedings connected were pending in 2013 and 2014, and still pending in 2016.

” It was a hiccup of the law ” ~ Quote by Barrie police detective Steele, after calling his cell number given to him from Stewarts files, and threatening a warrant for the arrest of the Human rights Applicants, after receiving complaints and further vexatious and harassing allegations from C A Stewart & Howard Tavroges.

Detective Steeles as a police officer, C A Stewart and H Tavroges as licensed paralegals, should have known or aught to known, Human rights Codes, the Criminal Code of Canada as well as, RTA 2006,LSUC Rules of Conduct, Rules of Procedures for proceedings and all other RIGHTS of the HR Applicant.

Other alleged police contact, threats and harassment will be posted on PRIVACY VIOLATORS website, when ALL the requested freedom of Information documents, video recordings and incident reports are collected.

Stewart and Tavroges as paralegals should have known or aught to have known the LTB Tribunal was an open and public forum for EVERYBODY, and as such the Applicant can attend whenever he feels the need to watch justice in action or whatever other reason he chooses to do so.

C A Stewart should have known or aught to have known not to obstruct legal methods of delivering legal documents and would probably not be served as often, in front of her colleges and peers, at the Landlord and Tenant Board Tribunal courtroom, located on the 2nd floor of 34 Simcoe Street, Barrie Ontario, Canada.

The documents were hand delivered to the legal office of Catherine Stewart of Landlord Legal inc, by a Mr B Graves, and not the involved party, though he had the right according to the Rules of Procedures to do so, when Stewart called the Barrie police again, this time, Cst Bareo (not sure of name spelling, but will be checking, when freedom of information and incident report requests are completed for ALL the incidents.)

Ralph Dykstra, William Dykstra and Donald Dykstra of Dykstra Bros Electric ltd / Paul T Smith / Catherine A Stewart / Landlord legal inc are ALL Respondents to the Human rights allegations, and have claimed to have hired Toronto based David Strashin, Sept 2015 to represent ALL parties, after paralegal Catherine A Stewart has represented involved parties since May 15th 2013, and alleged to have seriously delayed legal proceedings deliberately.

David Strashin has NOT FOLLOWED the Rules of Procedures for the HRTO 16250-13 (Dykstra Bros Electric) & HRTO 17699-14 (Landlord Legal inc / C A Stewart / Paul Smith). David Strashin is known to have other past business references, or relationships from 2011, with Landlord Legal as mentioned on the paralegals website on “In the News” category on, Hoarding Tenants.

The owner of Landlord legal inc, paralegal Catherine Stewart, has called the Barrie police on many unsubstantiated and false allegations against the HR Applicant since May 2013 when she was hired by Ralph Dykstra, Donald Dykstra and William Dykstra.

The property manager Catherine Stewart and her Dykstra Bros are alleged to have illegally entered/altered locks on Aug 15 2013.

Catherine Stewart, Ralph Dykstra, Donald Dykstra and William Dykstra DID NOT SHOW for the tenants rights application CET 33911-13 that accused them of the break in and lock change while the Barrie police watched.

Catherine Stewart calls the Barrie police on FALSE PRETENSES to “KEEP THE PEACE” knowing an LTB ORDER was in place, signed personally by Catherine Stewart ( SEE PARALEGAL RULES OF UNDERTAKINGS) and the tenant had legal possession of his rental unit !!. Officers M Beard and Cst Turner incident reports stating they told Stewart she DID NOT HAVE LEGAL DOCUMENTATION or the RIGHT TO ENTER but Catherine Stewart orders it done anyways !!

The paralegals alleged boyfriend Paul T Smith is also accused of Human rights violations against the past tenant caused when Paul Smith attended 40 Ellen Street, Barrie, Ontario in May 2013 to perform duties for Dykstra Bros, and Catherine Stewart.

Paralegals and Lawyers should not or should know NOT TO THREATEN or harass parties they are involved in proceedings against with CRIMINAL ARREST, FURTHER LEGAL THREATS or any kind of threat meant to harm the other party or to delay, coerce or influence the proceedings they are involved in.

Barrie police refuse to charge the paralegal numerous times with the numerous unsubstantiated and false allegations she makes, of the ongoing harassment, allegations of false documents submitted for legal proceedings or for Applicant to press criminal harassment charges for the break in and illegal lock change witnessed by attending police officers and instructing paralegal that she had NO RIGHT or LEGAL DOCUMENT required to enter 40 Ellen Street, Barrie Ont on August 15th 2013. when Catherine Stewart and the Dykstras’ were present and proceeded to order the locksmith to cut security chain and enter unit illegally.

Catherine Stewart, owner of Landlord Legal filed civil matters Oct 2013 against the ex tenant, knowing of the pending HUMAN RIGHTS matters, amended the SCC 1851-13 application after a year to a personal claim, being told the matter was in the wrong court and needed to go to a higher court to deal with the publication of legal proceedings against her and her Dykstra Bros Electric company of Barrie clients.

The paralegal website also depicts or has publicized a photo of Nima Wilson, a black female tenant, that was evicted several times and the story of the tenants involvement with the process, further harassing and embarrassing the poor tenant for Landlord-Legal-website-page-and-info-1Landlord legal paralegal firms own eviction advertising purposes for LANDLORDS to “EVICT TROUBLED TENANTS”

Catherine Stewart’s personal SCC1851-13 allegations are still pending, and public record, as of Feb 2016 and after she filed original claim in Oct 2013 to delay the Law Society complaints and the Human Rights allegations against her alleged boyfriend, her firm and Dykstra Bros Electric of Barrie owners’.

The SCC1851-13 civil matter filed by C A Stewart is still pending, as Stewart has taken NO ACTION after being told it was IN THE WRONG court.

Catherine Stewart also claimed she had hired David Strashin to represent her for the higher court in July 2014 but again has not taken any action to further her claims.

The Applicant has claimed his Charter Rights, Fundamental Freedoms 2(b) and will continue to defend the public forums, open court and HR publicized findings in all proceedings he is involved in with Catherine Stewart, Paul T Smith,Ralph Dykstra,Donald Dykstra and William Dykstra.

The paralegal should have informed her clients the LTB, Civil and Human Rights are public forums and public documents to the proceedings and freedom of information requested are public documents as stated on the bottom of the LTB forms and additional forms filed for proceedings and can be used as such.

Paralegals and Lawyers should know or aught to know not to create “CONFLICT of INTEREST” and if so, to remove themselves from ALL legal proceedings they are directly involved in.

Human Rights allegations filed against Catherine Stewart of Landlord Legal and Paul T Smith for discrimination against tenant Medical Marihuana grower

Catherine-StewartA Human Rights application was filed May 2014 by the ex tenant, against Catherine April Stewart of Landlord legal inc, acting agent and alleged boyfriend, 30 yr retired OPP Officer, process server and personal private investigator Paul Smith, for allegedly breaching  the Human Rights Code, discriminating against him when they illegally evicted the tenant for allegedly growing more plants than they figured he was entitled and licensed for.

Law Society complaints have been filed by the ex tenant against Catherine Stewart of Landlord Legal and her associate Howard Tavroges for CONFLICT OF INTEREST, RELEASING PRIVATE CONFIDENTIAL information allegations when  Howard Tavroges represented the tenant in several LTB matters, including the mediated agreement she failed to honor July 18th 2013, and represents Landlord Legal in many LTB Tribunal matters on her companies behalf.

LTB matters that Howard Tavroges represented for Landlord legal inc from July 2013 to Jan 2016 were recorded to send to the LSUC showing Tavroges worked for, and released private information to Catherine Stewart while Stewart proceeded in Superior Court against the tenant.

Howard Tavroges in May,June,July of 2013 had been a LTB paralegal with the Orillia Community Legal Clinic and had talked with and represented the tenant in LTB proceedings, also signed the LTB Joint Submission Order, against Catherine Stewart of Landlord legal inc,Ralph Dykstra, William Dykstra and Donald Dykstra of Dykstra Bros Electric. The tenant had to take Catherine Stewart and her Dykstra Bros clients to civil court to retrieve the LTB Order that Catherine Stewart personally signed the UNDERTAKING for her Dykstra clients.

The Human Rights Tribunal of Ontario (HRTO) received an application that was filed back in December 2013 from an ex tenant against Ralph Dykstra, William Dykstra and Don Dykstra of Dykstra Bros Electric of Barrie, Ontario concerning alleged medical marihuana privacy violations and discriminating against the tenant when they insist he only grows four plants when licensed for many more than they want him to grow.

Human-Rights0004The Human Rights claim is for discriminating against him for not allowing him to grow more than four (4) plants when he was licensed for an excess of that amount and was growing within his given license requirements legally. It is also states claims of Medical Marihuana Access Program privacy violation issues plus threats of reprisal, acts of reprisal, harassment and the illegal reasons stated in the N5 that Stewart attempt to evict him on un Constitutional grounds.

The court hearings between the tenant and Dykstra Bros electric started back in May 2013 when the tenant had taken the landlords, Ralph Dykstra, William Dykstra and Don Dykstra to the Barrie Landlord and Tenant Board tribunal for discussing private, confidential Health Canada Medical Marihuana Access program information with their very long time family friend and tenant, Nancy Groves.

LTB Judge Sean Henry heard the case in and determined the landlords did discuss confidential information with tenant & their longtime friend Nancy Groves (aka Nancy Aikens) on or about March 27th 2013. The LTB tribunal hearings did not end in May between the tenant and Dykstra Bros Electric with a simple apology.Nooooo !!

Ralph Dykstra, William Dykstra and Don Dykstra of Dykstra Bros Electric, hire Catherine April Stewart of Landlord Legal inc on May 13th to evict the tenant.

On May 23rd 2013, Catherine Stewart of Landlord legal or one of her agents posted a letter on behalf of her clients, the Dykstras, openly displaying private and confidential Medical Marihuana Access Program (MMAP) information concerning the tenant along with a “24 hour Intent to Enter” notice.The letter further demanded the tenant produce MMAP license information to her agent that was to perform the “Routine Maintenance” as she claimed in the 24 hour the intent to enter notice.

Paul Smith, alleged boyfriend and acting agent for Dykstra Bros entered 40 Ellen Street, Barrie for the notice, though a letter was given to Landlord Legal at their Barrie office located at, 117 Bayfield Street, the same morning as receiving her notice and revealing letter explaining a birthday party was already scheduled.

Read further details on the “Routine Maintenance” that turned into a full blown inspection with 100’s of photos being taken, many of personal and private documents, information belonging to the tenant. The inspection was done in spite of the tenants birthday party and in front of the tenants remaining guests from the scheduled birthday party. The tenant filed another LTB hearing CET #31816-13 against Dykstras and their agent for harassment and disclosing the confidential MMAP information and had a June 27th hearing date set to hear the complaint.

Stewart refused to provide copies to the tenant of the “Routine Maintenance”, inspection report or copies of the photos that her acting agent Paul smith had taken may 24th 2013 in written or email requests.

Catherine Stewart, sole owner of Landlord Legal inc refuses the LTB court summons,even from attending Barrie police officers, whom she had called on the tenant, on false pretenses, for her alleged boyfriend and agent,private investigator,process server and ex OPP officer Paul T Smith while attempting to serve the summons to Landlord Legal paralegal office on Bayfield Street, Barrie,Ontario.A follow up story to the Barrie police harassment allegations from the Dykstra Bros Electric ex tenant in relation to Smith sgt status before he retired from service and went to work as an acting agent for the paralegal firm landlord legal inc,Barrie,Meaford offices.

Catherine Stewart does not fill out the N5 properly identifying other hearings, past or present that were related to her application and before the Landlord & Tenant Board tribunal. The tenant had a previous hearing related to her N5 application, but not noted properly on the LTB forms. Landlord Legal owner Catherine Stewart was quoted as saying “I have 13 yrs experience, don’t tell me how to do my job” to Barrie police Aug 15th 2013.

Catherine Stewart files an N5 ” Notice of Early Termination” on grounds the tenant would not produce the Health Canada MMAP information she demanded in her letter and refused to give an un blocked copy to Paul Smith, who asked for the license information without any authority to do so and in front of the tenants guests. The tenant was posting all of his LTB hearing information following his adventures through Landlord and Tenant tribunal complaints against the paralegal and her clients and Stewart wanted the postings stopped and this website shut down.

The LTB matter is mediated by LTB mediator Dawn Lewis, Community Legal clinic paralegal Howard Tavroges ( NO LONGER WITH ORILLIA LEGAL CLINIC, though his current Upper Law Society of Canada profile still shows the Legal Clinic phone number and fax) theorig-mediation-agreement tenant and Catherine Stewart.

The mediated agreement order was to return last months rent and tenant would voluntarily move out on August 15th 2013 to file his Human Rights claim in peace and his living environment was already poisoned from the Dykstras revealing his confidential MMAP information.

** On move out day, August 15th 2013, Catherine Stewart of landlord Legal and her clients were present at the tenants 40 Ellen Street, Barrie, Ontario residence and called Barrie police on false pretenses to the unit to watch Catherine Stewart and her clients instruct Central Lock & Key of Barrie to break the front door lock, cut the security chain and enter the unit to change the locks.

** Did we mention that the tenant was moving out already voluntarily and had a court order that instructed Landlord Legal to apply for a Sheriffs order if not vacated as per agreement. Ralph Dykstra,Donald Dykstra and William (Bill) Dykstra corporation owners of Dykstra Bros Electric did not want to honor the agreement they made in LTB court July 18th 2013 and signed by Catherine Stewart with full authority to do so from William Dykstra, the only one of the Dykstra brothers that were present in court.

The tenant files another LTB complaint CET #33911-13 against Catherine Stewart of Landlord legal and Dykstra Bros Electric for harassment and the illegal entry and lock removal incident on August 15th 2013

Catherine Stewart of Landlord legal inc and her clients FAIL TO APPEAR for the hearing date set and DOES NOT NOTIFY the tenant, summoned witnesses or the LTB courts before the hearing.

Barrie police officer M Beard was summoned and present for the hearing as was Central Lock & Key owner and his employee and another witness that was in the unit at the time they forced themselves into the unit without proper documentation to do so.

Stewart sends another paralegal to claim she is out of the country and the judge orders Stewart prove he claim when the hearing is rescheduled again.

The tenant has pendingCentral lock and key enters unit illegally court actions against Central Lock & Key for the break & enter and the Barrie Police department for the tenants rights being violated as they stood by and watched knowing Catherine Stewart did not have any legal documentation for what she instructed the locksmith to do.Another Upper Law Society complaint was filed against C A Stewart of Landlord Legal for her presence at 40 Ellen Street on August 15th 2013 and her instructions to the police and the locksmith.

The tenant has also written the Upper Law Society of Canada over paralegal, Howard Tavroges involvement with Catherine Stewart of Landlord Legal in LTB tribunals in Barrie at the same time as the tenant is suing her clients for the agreement he had initially made with her on his behalf.

** Concerns and allegations of past Orillia Legal Clinic, paralegal Howard Tavroges, divulging client privileged information to Catherine Stewart during the launching of the civil suits Stewart & Dykstra Bros Electric filed against the ODSP recipient and tavrogesex tenant had arisen when Stewart used the information to contact the Orillia Community Legal clinic with threatening letters over alleged websites that were discussed in confidential discussions with Howard Tavroges and Orillia Legal Clinic director Michael Hefferon,tenant and involved parties, directly in LTB matters in May & June of 2013.The tenant asks for minutes from the meeting to be provided as recording device was not allowed in this confidential discussion of the tenants right to grow medical marihuanna and the LTB process ahead of him and did receive the information he requested.

** Catherine Stewart also filed a civil lawsuit against the tenant over one of the alleged websites, without any documentation to prove who owned it.

A minimum fine of $25,000 and a year suspension if the tenants ULSC complaints are heard and Stewart found guilty of his claim.

C A Stewart and William Dykstra tell the attending Barrie police officers M Beard and Turner that Stewart had received an email from the Privacy Commissioner of Canada stating the tenant had contacted them and had vacated days before.

** The ex-tenant files civil case SCC #1546-13 in Aug/2013 to retrieve owed funds from Dykstra Bros Electric of Barrie,Ontario.

** The tenant finally receives the owed funds in May 2014, after Dykstra Bros Electric and Landlord Legal knowingly waste Civil Courts time, Orillia Legal Clinics time & resources plus the ODSP recipients time & money for many months, attempting the owed LTB ORDER they had willingly signed, for the order.

Barrie police refused again when a document from C A Stewarts office was served by Paul T Smith, which severely harassed the HR Applicant, (he had representation) and at a residence that WAS NOT on file anywhere.Incident report to be posted soon.

Barrie police refused to charge Stewart and Smith for allegedly entering a document into legal proceedings, alleged to be NOT ON FILE with North LTB main office. HR Applicant discusses issue with Barrie police Det Steeles, says LSUC matter. The Applicant also discusses the unsubstantiated allegations Stewart mentions in her HR Response of the LTB Hearing attendance she made to him previously that were referenced to it in her HR Responses and told him the deal he made weeks prior was off.Incident report will be posted when All documents and video compiled.

The HR Applicant had made a deal with Det Steeles, not to mention the events after being threatened with an arrest warrant, and called on his cell to be forced to attend Barrie police station, if those unsubstantiated events do not get mentioned or attempted to be used against the HR Applicant, in any way shape or form by C A Stewart, then he would not send the freedom of information and talk of the incident online. Stewart of course uses the unsubstantiated claims by Howard Tavroges and herself to attempt to damage the HR Applicants character.

Barrie police refused to charge Stewart and Barrie Innisfil, Ontario resident, Rob Scruton, Stewart signs and enters a Rob Scruton sworn testimony into Dykstra Bros Electric legal proceedings, refused to show for the motion to dismiss the unsubstantiated and, unproven claim, it never had 1 day in court, Stewart was aware of these facts, serves it against the rules, enters it anyways, and in fact the false allegations from Rob Scruton were withdrawn.

.Catherine Stewart, owner of Landlord Legal filed civil matters Oct 2013 against the ex tenant, knowing of the pending HUMAN RIGHTS matters, amended the SCC 1851-13 application after a year to a personal claim, being told the matter was in the wrong court and needed to go to a higher court to deal with the publication of legal proceedings against her and her Dykstra Bros Electric company of Barrie clients.

*** Legal documents were delivered Aug 11 2015 to the Respondents address on file for pending Human Rights proceedings against her clients and her legal firm, located at 117 Bayfield Street Barrie, Ontario when Catherine April Stewart tried AGAIN, to have the Applicant charged, for trespassing, or whatever the police would be willing to charge him with from her allegations !!

The Barrie Police officer in question, harassed the Human Rights applicant, calling a personal cell number given to him from C A Sewarts’ HRTO file contact number to demand he turn himself in to talk of the Stewart allegations of trespassing Aug 11th 2015.

The officer demanded that the Human Rights Applicant come into the police station, again for questioning, the HR Applicant told him “NO FUCKING WAY” and told him to STOP CALLING THE CELL NUMBER, stop HARASSING HIM and go talk to Mr Graves, the person who delivered the legal documents if he had a problem.

A video recording and incident report was filed by this Barrie police officer after talking with Graves. Stewart still attempted to push Cst Bareo of the Barrie police department to charge the HR Applicant, with anything they could find !..Incident report will be posted with the video soon.

Another false allegation to the Barrie police involved Detective Cst Steele, in which he called the Human Rights Applicants cell phone as well and THREATENED to have a WARRANT ISSUED if he did not turn himself into Barrie Police, for the false allegations of Howard Tavroges and Catherine Stewart stemming from Applicant ATTENDING a public and open forum Landlord and tenant Board courtroom, to obtain FURTHER PROOF of Howards Tavroges conflict of interest, releasing private and privileged information to Stewart while he had signed, worked in paralegal capacity for the ex tenant. Tavroges signed the agreement with Stewart on July 18th 2013 for an LTB Order, which she made the tenant take to civil to retrieve while Tavroges represented her firm in LTB matters at the same time in 2013 and 2014.Detective Steele is quoted as saying

” It was a hiccup of the law ” ~ Quote by Barrie police detective Steele, after calling the tenant’s cell number threatening a warrant for the arrest of the Human rights Applicants, after receiving complaints and further vexatious and misleading allegations from C A Stewart & Howard Tavroges.

Catherine Stewarts personal SCC1851-13 allegations are still pending, and public record, as of Feb 2016 and after she filed original claim in Oct 2013 to delay the Law Society complaints and the Human Rights allegations against her alleged boyfriend, her firm and Dykstra Bros Electric of Barrie owners’.

The SCC1851-13 civil matter filed by C A Stewart is still pending, as Stewart has taken NO ACTION after being told it was IN THE WRONG court.
