It has come to Privacy Violators website attention, through numerous emails, that a yet unnamed Ontario Police Officer from Meaford has harassed several Canadian citizens instead of investigating known complaints of an ex OPP officer, Paul Smith practicing as a private investigator for several years, while un sanctioned to do so in Ontario.

Ex OPP officer Paul Smith has been known to operate as a process server, a witness and an illegal private investigator for owner and wife, Catherine Stewart of Landlord Legal, Barrie, Ontario and is being protected by fellow OPP officers in Meaford, Ontario.

Paul Smith has been known to state in courts documents, that he has had a private investigator license for over 6 years but he was not sanctioned by any registered and legal company to operate in this capacity in Ontario Canada.

Smith has been known to give statements in landlord and Tenant board, Civil Court, Human Rights tribunal and to the Privacy commissioner of Canada, which were signed by his paralegal wife stating he was a private investigator working for his wife, Catherine Stewart’s paralegal firm landlordlegal inc. Stewart has been known to use her commissioner stamp to sign documents she submits from Paul Smith to further her landlord only clients cases she acquires through her phony property management company she runs to manipulate the LTB board when she represents land lords ONLY under the name April Stewart which is not the name on file at the Law Society of Upper Canada to practice law in Ontario.

Stewart’s landlord only fake property management company does NOT ALLOW tenants to contact her PM office for any reason, even emergencies. New complaints are pending and have been filed again against this Ontario paralegal, Catherine Stewart, with the LSUC for practicing law under several names that are not registered with the Law Society with numerous harassment claims, as well as procedural complaints with Stewart.

Send us your emails concerning any known instances of the Meaford OPP protecting their own officers and failing to investigate them when it comes to ex police officers breaking the laws in Ontario.

Law Society paralegal Catherine Stewart is well known to sign her name as April Stewart in court and then refuses to honor agreements she makes.

Catherine April Stewart, a licensed paralegal registered with the Law Society of Ontario, claims to be an eviction specialist and a landlord only advocate, but also runs a small property management company from a small cubicle office located at 117 Bayfield Street in Barrie Ontario.

As a property management company, Catherine Stewart refuses to allow any of the tenants she manages for her landlord only clients to enter her offices or to contact her over ANY tenant issues. A very strange rule for a legitimate property manager running a business representing clients to their tenants.

Catherine Stewart was present at a break and enter, ordered and committed by the paralegal, when she ordered a Barrie locksmith to enter a tenant’s residence without the legal right to do so which was witnessed by Barrie police officer’s Melanie Beard and officer Turner, who both refused to press charges against her when the tenant insisted they do so.

Read the police report from the officers and the many articles of violations that this paralegal commits, all in her self proclaimed status of being the “terminator”.

Being present and ordering the break and enter is another violation of the Law Society but the complaint that was filed in 2013 does not even appear anywhere on her profile to warn the public. David Cass headed that complaint off and refused to hear it even though the police reports were submitted to the law society to prove the claims.

Catherine Stewart is also known to use and sign the name April Stewart in the LTB hearings, which is not registered with the Law Society to practice law and then fails to honor any agreement she makes to make the tenant waste time and money going after the order she had agreed to and signed in the Landlord and tenant board.

Paralegals, according to the Law Society rules, are suppose to honor agreements they make in court which shows you what kind of paralegal Stewart really is when she states in LTB hearings, she is “a landlord representative” NOT LEGAL REPRESENTATIVE, as she does not fit the legal definition of a landlord in LTB and then signs a different name not registered with the law society and continuously fails to honor the agreements she makes.

The tenant filed complaints in the LTB courts for the break and enter after he vacated the unit but Catherine Stewart lied to the courts on the hearing day when Stewart sent another paralegal friend claiming to “Be out of the country September 21st 2013”. Witnesses can put Stewart in Meaford, Ontario when she was suppose to be in court to answer for the break and enter allegations.

Catherine Stewart’s husband, Paul Smith has been known to work for Stewart for over 10 years as a process server and other jobs his wife needed done for her property management company named landlord legal, including signing false documents for her to win cases for her landlord clients.

Paul Smith, an alleged retired OPP that has never been proven has been known to act, not only in the capacity of a process server for his paralegal wife, but has been known to enter tenants units every time they plan to evict a tenant for her landlord only clients and completely  photograph the tenants units before the eviction process begins in the LTB courts.

This photographing that Paul Smith does not only violates the Landlord and Tenant board rules but also violates the constitutional rights to privacy that is suppose to protect the tenants and their families.

Paralegal Catherine Stewart’s husband, Paul Smith has been known on several occasions to file false testimony and enter false evidence that is often signed by his paralegal wife or one of her friends in order to manipulate the courts.

When Catherine April Stewart of landlord legal enters this false testimony and false evidence, she is committing a crime, but gets away with it every time when she claims she has “ABSOLUTE PRIVILEGE” as a paralegal to do so.

Paul Smith has been known to illegally contact the Human Rights applicant during the time Smith and Stewart had been named in the Human Rights allegations and was presently before the Human Rights Tribunal in Toronto.

Although Paul Smith was directly named in the claim, he contacted the applicant directly which is against the law to harass a HRTO applicant and had made the applicant very concerned for his safety during the ongoing HRTO hearings.

Smith has also been known on numerous occasions to use statements, issued and signed as a private investigator when Paul Smith was not legally licensed to perform as such in Ontario. This alleged ex OPP officer has never had to prove he was a OPP officer or his legal private investigator status that he uses for his paralegal wife’s advantage in the Ontario courts.

Paul Smith even appeared on the stand as a witness in a civil case when he was not involved or even on the witness list that was given to the opposing party before the trial, as ordered by the judge hearing the case.

This pair has continued to get away with their manipulative tactics because Stewart is a paralegal and claims absolute privilege when defending a landlord client or in this case, Stewart and Smith when they were directly named in the Human Rights allegations.

There is definitely something wrong with our court system when a one year graduate gets a paralegal license and can lie, submit false evidence and continue to mock and manipulate the LTB boards and the the Ontario courts, all the while claiming to be a landlord rights advocate.

Many complaints have been filed with the Law Society over paralegal Catherine Stewart’s conduct, false testimony and her entering false evidence into courts, which is illegal in our court system, but if you look at her profile in the Law Society it will not even show one complaint. The Law Society uses its employees like David Cass, to head off any complaints that do come before them.

The Human Rights mediator hearing the allegations against Stewart and her husband for HRTO 16799-14, Mary Truemner stated in the courtroom that Stewart had definitely crossed the line and violated the tenants rights but had upset the applicant with some very ignorant comments in mediation and a very ridiculous proposal for a punishment that it made the applicant walk out of the hearing in disgust.

The Human Rights mediator hearing the case, Mary Truemner had stated Catherine Stewart was guilty and was suggesting that Stewart take an online Human Rights course and put up a Human Rights poster in her office as a remedy for her violations.

This very ridiculous remedy and other aspects of the Human Rights process will be discussed in full for the public to see that the registrar Richard Hennessy and the entire HRTO process in Ontario is a joke.

The HRTO mediator, Mary Truemner refused to hear the false evidence and false statement claims brought up by the applicant although the proper paperwork was submitted to the tribunal. The evidence and witnesses were concrete and could without a doubt prove that Catherine Stewart and her husband Paul Smith submitted the false statements and evidence into the hearings to protect their reputations.

The entire HRTO hearing will be discussed and many of the documents put online to show the public what one year graduates for a paralegal license like Catherine Stewart, will do in our Ontario courts and how they get away with it.

Many documents, statements, evidence submitted and emails received from the Human Rights tribunal of Ontario and the Law Society will be also be posted online to show what the Law Society does to protect paralegals and lawyers when legitimate complaints are filed with their office.

New complaints against Stewart have been filed with the Law Society and we will post all communication, documents and emails received concerning the complaints to further educate the public on how they protect dirty paralegals as long as they pay their fees to the society. You have to ask yourself why so many complaints that can be proven to be filed with them never get heard and never appear on their public profile that is accessible to the public. Corrupt Barrie Police fail to investigate ex OPP officer Paul Smith for impersonating as Private Investigator and violating tenant Constitutional Rights to privacy !

When the public and especially tenants in general have issues with violations to their privacy, break and enters and the methods used by their landlords and illegal practices from paralegals such as Catherine Stewart of Walter’s Falls & Barrie Ontario, where do they go for protection ?

Normally ANY citizen of Canada or a tenant would call the police for help, file a complaint at the Landlord and Tenant Board (LTB) or possibly file their allegations with the Human Rights Tribunal of Ontario (HRTO) or exercise all three possibilities according to their rights.

Many complaints of paralegal Catherine Stewart’s illegal practices, of break and enter, illegal searches, constant harassment of a HRTO applicant, entering false testimony, entering false evidence have all gone to the Barrie police to investigate from a tenant who had filed many complaints and allegations against Catherine Stewart and alleged retired and decorated ex OPP officer and boyfriend Paul Smith.

Police chief Kimberly Greenwood, of the Barrie city police, Ontario Provincial Police Commissioner Vince Hawkes, Human Rights Commissioner Renu Mandhane along with the Canadian Law Society have all failed to protect many rights given to Canadian citizens and continue to ignore and put under the rug, any legitimate complaints brought forth by Canadian citizens against this alleged ex Ontario provincial police officer !!

A quote is stated below from Detective Steeles when he threatened to put out a warrant on a Human Rights applicant over allegations the ex tenant was appearing at the open forum at the Barrie LTB board where Catherine Stewart was defending a landlord illegally according to the LTB Act 2006 ! Stewart complained to the Barrie police the ex tenant was attending the LTB hearings in Barrie which is his right to do so ANYTIME he wants to as it is a PUBLIC and OPEN hearing.The Barrie police had NO REASON to harass the ex tenant and Human Rights applicant for attending LTB hearings. Detective Steele also ignored the false evidence claims and the false testimony claims when the applicant tried to have Catherine Stewart and her ex cop boyfriend charged with the offenses.The FOI with Turner, Beards and Steeles police reports will be posted for the public to view.

Detective Steele did not do ANY INVESTIGATION into the allegations made concerning the harassment, false evidence and false statement claims brought up against Smith & Stewart but did threaten to have a warrant issued for the applicant for attending LTB hearing. WOW Barrie police justice is far between and completely corrupt !!

The Freedom of Information act allowed the harassed citizen to retrieve copies of police reports filed by Beard, Turner and Steeles along with other Barrie police officers who allegedly harassed the human Rights applicant and his friends when trying to find false allegations to press charges against the applicant to further help the ex OPP officer and ignore the legitimate complaints filed with them concerning severe harassment and breaches of court conduct when in legal and court issues involving Catherine Stewart and Paul Smith personally.

We will be posting every Freedom Of Information report that has been obtained from every police force involved and every pertinent file from the Human Rights Tribunal to expose the truth about Catherine Stewart, Paul Smith, our legal system and the police protection that we are suppose to have as citizens in Canada.

BEWARE OF THE FRAUD TACTICS IN LTB. Stewart is also known NOT TO GIVE DISCLOSURE for LTB hearings, do not allow this injustice to continue with this scum who is a self proclaimed “terminator” . Tenants have rights that are constantly violated by this property manager who is a paralegal illegally acting on behalf of LANDLORDS ONLY in LTB matters. New complaints have been filed with the Law Society concerning Catherine Stewart tampering with Civil court documents and entering false evidence and false testimony into the Human Rights allegations she was accused of. Past complaints filed against Stewart were ignored when David Cass, intake worker for the LSUC dismissed complaints when Stewart lied about ongoing court cases when there was none presently before the courts at that time. Stewart had submitted no evidence to David Cass when he dismissed the complaints blindly.

We have received several emails about complaints to the LSUC filed against paralegals and lawyers mentioned in several of our public interest stories, and David Cass has been at the center of a couple of the complaints and dismissed them as well without proof or justifications for his actions. The complaints that we know for sure that have been filed have not showed on the paralegals public record at all after David Cass puts them under the rug and fails to protect the public.

The LSUC is more concerned that paralegals pay their yearly fees to them than they are in protecting the public from paralegals who openly and knowingly break the law and the Rules of Conduct set out by the LSUC. We will be writing further about the complaints filed and the LSUC Rules and Regulations that are suppose to be in place so the public can see the real truth about our legal system. The truth will scare you more than you think if you think we live in a FREE Canada.

David Cass is protecting Lawyers and Paralegals from complaints that are legitimately filed against paralegals and Lawyers without justifying his reasons or the persons providing proof of their claims they make to protect themselves. The Law Society itself is a self run body that only protects lawyers and paralegals from the complaints that are shoved aside without proof or justification and never heard.

Privacy Violators has evidence of at least 4 other complaints filed with the LSUC against Stewart but there is no records of ANY complaints being filed including Break & Enter complaints filed in 2013 from a Barrie tenant. The Law Society intake process is as crooked as the cops when they do not protect the public from the Hard Practices of paralegals who knowingly break the laws for their clients. This leaves only one option for tenants when coming across these low life paralegals and that is to defend yourself to the max because the system is rigged against you.

The phoney property management company Catherine Stewart runs is from a small cubicle office surrounded by numerous accountants in a firm there, and the building is owned by Wendy Kara of Sophia development Corporation.

These accountants have been known to receive confidential and private legal documents that were intended for her legal firms eyes only but has on numerous occasions received unprotected legal documents on her behalf when she operates her legal firm from her Walters Falls residence.

Stewart had closed her failing Meaford legal office last year after she neglected to inform the Civil courts and the Human Rights of the closure of her office that was on record to receive the legal files from Human Rights allegations brought up against Stewart, her husband Paul Smith and her landlord clients Dykstra Bros Electric.

Stewart has been known to make many deals under this name and is now very well known not to honor any agreements she makes with tenants only to have them take the matter into civil courts wasting their money and valuable court time for her purposes.

Stewart has also been known to harass Human Rights applicants when she complained to the Barrie police the tenant was showing up at the LTB hearings which is an open forum to anybody thatwishes to go. Under the LTB Act 2006 Stewart does NOT FIT the definition of a landlord and should not be practicing law representing her slum lord clients.Paul Smith has also been known to work illegally as a Private Investigator for this paralegal when he was not licensed to do so in Ontario. New complaints have been filed again against Catherine Stewart with the Law Society of Upper Canada who has been known to protect lawyers and paralegals when they break the law or even the rules set out by the society to govern the conduct of these one year graduates who receive a law degree from shady colleges in Ontario.

The writer had filed Break and Enter complaints against Stewart that were dismissed when David Cass, LSUC intake officer dismissed without reason or evidence in September 2013. David Cass is accused of protecting paralegals even though they violate the rules set out governing the conduct of paralegals and lawyers by the LSUC.

Barrie Court House* * Barrie Civil Judge Kalwoski breaks rules of the Justice act as a fair and impartial judge when he hears cases involving the retrieval of a LTB Order, and other additional motions involving SCC#1851-13 & SCC#1852-13 where he calls Catherine Stewart to his chambers during ongoing proceedings without the other party being present. It is suspected Judge Kalwosky had put personal notes in the court files to influence the outcome of the future Superior Civil Court proceedings !!

 

Diane Smith Paralegal -Barrie** Diana Smith was found to be practicing law under different names when she was not legally licensed by the Law Society of Upper Canada to practice law in Ontario.Diane Smith sold her house and moved to Newmarket with her son to avoid future civil cases filed against her. She did not show for the allegations against her at LSUC hearings.

** Toronto lawyer David Strashin was aware of the false testimony, and false evidence allegations concerning his client, and friend paralegal, Catherine Stewart. Stewart had filed Human Rights evidence herself, well past the given date stated by the HRTO Registrar, Richard Hennessy for proceedings held in Toronto, Canada. (HRTO 16799-14 & HRTO#16250-13).

The late evidence was allowed into the proceedings as was David Strashin allowed to represent her, after Strashin and Stewart break HR rules of procedure, neglecting to properly notify the tribunal or the other party that he was her legal representative.

Evidence from the applicant was still delivered to the offices of Catherine Stewart, legal contact on file, when no evidence that Strashin was given that he was now the legal rep on file, as per the rules for contact information, to receive any evidence or documents pertaining to the hearings as far back as August of 2015.

Ex OPP officer worked as private investigator for many years, unsanctioned and illegally for Walters Falls paralegal !

oppAn ex Ontario Provincial Police officer, Paul Smith, has been investigated during Human Rights allegations (HRTO #17699-14) that were brought up against Smith, and his paralegal girlfriend, Catherine A Stewart, and has been discovered to be working as a private investigator illegally for landlord legal inc, of Barrie Ontario for many years.

Although Paul Smith did indeed have a private investigators license for over 7 years, Smith was not sanctioned by any private investigator company to work legally as a private investigator, but continued to give signed statements mentioning his PI reports and PI status, as well as being a retired Ontario Provincial Police officer, in sworn statements given to, and signed by his paralegal girlfriend who has a commissioner stamp to do so. One lies and the other swears to it.. very convenient for paralegal, property manager Catherine Stewart when she signs the legal documents to defend her LANDLORD ONLY clients.

Smith would give false evidence, false testimony, and stated whatever, property manager and paralegal girlfriend, Catherine Stewart needed to be sworn and she would protect him from liable suits, Human Rights allegations and criminal actions brought up against him, stating “absolute privilege” while she acts as his paralegal protecting these lies they swear to. Barrie Police officer Det Steeles, refused to investigate the false evidence allegations brought up to him concerning Smith.

Paul Smith was further accused with Catherine Stewart of entering false evidence, which Smith had signed and gave to Stewart for evidence into HRTO #17699-14, which both parties were named in Human Rights application.

Ex OPP officer Smith, was also involved in breaking many more Rules and Procedures for Stewart, in the Human Rights (HRTO#17699-14) allegations brought against Smith and Catherine Stewart when he contacted and delivered legal documents to the Human Rights applicant at an address NOT ON FILE when the applicant had legal council representing him.

The illegal personal contact by ex OPP officer Paul Smith, is against any Court Hearing Rules, as well as the Human Rights rules when legally represented, alarmed the HR applicant and made him afraid of what the pair would do when, consistently and knowingly they both were brazenly breaking laws and rules for their HR allegations against them. Paul Smith has admitted working as a PI and process server for his paralegal girlfriend for over ten years and should know the laws and rules and regulations governing process serving.

The pair have gotten away with tactics like this for a long time and Barrie police office Steele received complaints Barrie policefrom the Human Rights applicant, of these tactics and actions but did not investigate nor act on the complaints. It seems like the Barrie police service also works for Catherine Stewart as well, when they do not investigate legitimate complaints filed against the paralegal for break and enter, entering false evidence and harassment allegations or the ex Ontario Provincial Police officer involved !! We can only assume the Barrie Police and the OPP protect their own when they do not investigate these complaints !!

Human-Rights-DignityHuman Rights Registrar, Richard Hennessy of the Human Rights Tribunal was well aware of the allegations and many more motions brought up by the applicant in HRTO#16799-14, but the mediator, Mary Truemner did not hear any of the motions brought forward, instead this unfair mediator swept it under the rug and refused to hear them !

After a long investigation, and many emails received, the stuff that paralegal Catherine Stewart has done in the past, and has gotten away with it, even when the Law Society is aware of the allegations is staggering and the public needs to be aware of the tactics used by a few of these known paralegals, who go to a college training school for one year and bought their licenses and have nothing to lose.

The Landlord and Tenant Board rules do not allow one party to have an advantage over another when preparing for an eviction or an LTB  hearing, which makes the photos ineligible to be entered into evidence as LTB Judge Sean Henry states in the May 7th, 2013 transcripts to be published in a future post.

Paralegal and property manager, Catherine Stewart has been accused in the past of breaking into a tenant’s home while Barrie police officers, CST Turner and CST Melanie Beard stood by and watched. The Barrie police officers would not charge Catherine Stewart, Ralph Dykstra, William Dykstra or Donald Dykstra with break and enter although they witnessed it first hand, stating it was a landlord and tenant board matter. Catherine Stewart has been known to give confidential court information to the Barrie police, in the form of a private cell number that was given for court purposes only.

The tenant involved did file a LTB complaint (LTB #33911-13), stating paralegal Catherine Stewart and her landlord clients ordered Barrie’s Central Lock and Key owner, Paul Robertson to cut a security chain, pick the lock and enter 40 Ellen Street, Barrie Ontario while the Barrie police watched. Barrie Police Constable Melanie Beard was summoned and present for the LTB hearing, as were the locksmiths involved, for the break and enter allegations, but Catherine Stewart neglected to show for the allegations against her, stating she “was out of the country” when witnesses to the contrary were available.

Ex OPP officer, Paul Smith and Catherine Stewart, both of Walters Falls, Ontario have been known in the past to use Smiths’ ex OPP status and his illegal private investigator license to influence the Landlord and Tenant Board hearings that paralegal, Catherine Stewart, takes on defending Landlords only.Smith was also involved in Privacy Commissioner complaints against Stewart where he gave statements claiming he was a licensed PI working for Smith when he entered and took 100’s of photos of a tenants unit prior to Stewart preparing for a forced eviction hearing.

The paralegal / property manager hides behind online applications on her website to screen clients and has signs posted on a door at her little cubicle office located at 117 Bayfield Street stating No Tenants allowed but she is a property manager. Figure that one out, a property manager that wants no contact with the tenants on behalf of her landlord clients.. that says a lot of her intentions and tactics !!

There have been many posts alleging the privacy violations done, false evidence submitted, false testimony submitted, and the many laws, and rules and regulations that Catherine Stewart has been known to commit while manipulating rules and hiding behind her landlord only advocate role.

Any tenant who goes against Catherine Stewart in LTB, should be aware that Catherine April Stewart is not legally allowed to represent landlords in LTB hearings as both a paralegal and a property manager and should make the Judge at the LTB hearing aware of the conflict of interest she is in when she does not fit the definition of a “Landlord” but references herself as a “Landlord representative” in any court documents and signs them as April Stewart, which is not her legal name !!

Human Rights Tribunal of Ontario…What a joke.

After a long needed vacation and a trip across Canada, the writer is ready to discuss the Human Rights allegations and evidence that were brought up against a Walters Falls paralegal, Catherine April Stewart and her ex OPP officer boyfriend, Paul Smith, also of Walters Falls and can now be brought online to the attention of the public to see the injustice that is allowed in our Ontario court system from the Barrie Landlord and Tenant Board (LTB) to the Barrie Civil Courts all the way to the Human Rights Tribunal of Ontario (HRTO) and the neglect of the Law Society of Upper Canada (LSUC) to investigate the legitimate complaints filed by Canadian Citizens.

The HRTO allegations referred to are against paralegal & property manager Catherine April Stewart and ex OPP officer Paul Smith from HRTO file number 17699-14.You can request any of the documentation found here on our website from us at privacy violators or apply under the Freedom of Information with any of the file numbers given.

Along with Human Rights violations alleged and admitted to the wrong doing by the HRTO were allegations of false documents entered into evidence from Paul Smith which were notarized and witnessed by his paralegal girlfriend, Catherine Stewart who also represented the ex OPP officer and herself at the hearing until she admitted in April 2016 that, and I quote “she knows nothing of the Human Rights process” as we waited for her new lawyer, David Stashin to arrive at the hearing 2 1/2 hours later.

The false evidence allegations against Catherine Stewart and Paul Smith that was filed with the Human Rights Tribunal of Ontario had been ignored even though the applicant had filed the proper documents to HRTO stating the evidence did not exist at the North Toronto LTB office. The original evidence submitted as well as all the correspondence from the HRTO is to be uploaded for the public to see what paralegals can manipulate in our Ontario courts.

Walters Falls paralegal, Catherine April Stewart refused to proceed at the scheduled HRTO hearing until David Stashin arrived to take over after she herself submitted false evidence and testimony to which she herself signed with her Commissioner of Oaths Stamp for her own allegations against her and her ex OPP boyfriend Paul Smith.

Catherine April Stewart lives in Walters Falls and is a paralegal licensed by the Law Society of Upper Canada.
Catherine April Stewart is also a property manager running her paralegal and property management company from a small cubicle office from 117 Bayfield Street, Barrie Ontario.

The paralegal uses Landlord Legal inc for her paralegal services and signs Catherine April Stewart when working in this capacity.

The paralegal uses a property management company called Landlord Legal which is known to sign April Stewart when working in this capacity.

The property manager is a self proclaimed “LANDLORD RIGHTS ADVOCATE ONLY” and uses her Landlord Legal website to announce she is the self proclaimed”TERMINATOR”

The Landlord Legal website owned by Catherine Stewart is known to publicly threaten a tenant who had filed Human Rights allegations against her and her known boyfriend.

The property manager sends out “Do not Contact” and “Do not Trespass” letters without a letterhead making it look like it came from a legal office but was from the property manager capacity.

The paralegal is breaking rules of the Law Society by working in this conflict of interest positions as a paralegal and a property manager.

The paralegal is breaking rules of the Landlord and Tenant board when she represents landlords because she is a property manager but neglects to tell the opposing parties or the Landlord and Tenant Board she is also a paralegal and does not fit the definition of a “LANDORD” in the LTB courts but rather states she is a “Landlord Representative”.

Catherine April Stewart is known to sign April Stewart as a property manager, even with legal court documents when her legal name is Catherine April Stewart.

Catherine April Stewart is also known to use her ex OPP officer boyfriend, Paul Smith to do illegal searches of tenants residences and to sign her Commissioner of Oaths Stamp to testimony from her OPP alliance to further her clients interests.

The upcoming posts are going to be many, to put the truth online and the truth behind the corruption that is allowed in the Ontario Provincial Police force, the Barrie City Police force, the Barrie Civil Courts, the Ontario Human Rights Tribunal and the well known tactics used by many paralegals that are swept under the rug from the Law Society of Upper Canada.

Privacy Violators will post the evidence used, documents submitted, and the testimony and methods used by paralegals like Catherine April Stewart disguising themselves as property managers but practice Law openly, getting away with breaking the Rules, Laws and Rights set in place for people that honor the laws and rights of Ontario citizens.

Privacy Violators has also learned of other complaints filed with the LSUC against David Strashin and Catherine Stewart but there is no records of any of the complaints filed on their Law Society profiles, including the complaints filed July 2014 against Catherine Stewart of Landlord Legal inc misrepresenting herself as Landlord Legal, property manager.

New complaints to the Law Society of Upper Canada are being filed against these individuals and will be well watched by Privacy Violators and other websites that have expressed interested in these stories being ignored by the so called protectors of our rights.

The truth is the Human Rights Tribunal is the biggest joke in Ontario and the details to prove this will develop over the next few weeks on our website with all the documentation and communications that transpired for HRTO file numbers 17699-14 and Dykstra Bros Electric HRTO 16250-13.

The HRTO admits the applicant was not treated fairly and quite frankly the process was a joke and the evidence that will be uploaded is there for you to make your own judgement with the HRTO system in place.

These are true facts Stewart does not want you to know before she attempts to evict you.

We only list some retaliation possibilities that you can consider doing and leave the decisions and actions up to you. We take no responsibility for any actions that may have been taken per our suggestions listed below. We will be adding more suggestions listed below as members voice their opinions and emails continue to come in. Tenants have rights to !

The goal here is to cost the landlord as much money as possible with damages and legal fees if they try to come after you for any costs involved with the eviction, you are protected by the Landlord & Tenant Act and ODSP Act section 18 and section 51(1) of the ODSP Regulations.

Intent of Policy :To ensure that a recipient’s income support is protected from seizure and garnishment by creditors or transfer to another party to satisfy a debt.

As with Stewart being protected for her illegal methods, you are also protected if you are on ODSP or Public Assistance and can not be garnished for any reason.The landlord will have to come up with the money to fix the place and all legal fees required to attempt to pursue any LTB or Civil Court actions to get the damages recovered, and you simply don’t show up as Civil Courts in Ontario are Mickey Mouse and a Kangaroo court anyways.They will not be able to recover any money even if the court awards damage and cost against you. Their tough luck !

Let the landlord waste their time with the paperwork and the extreme costs involved to try and recover any of the alleged damages to their property. Have no mercy when you are being harassed and feel threatened by this invasion of a paralegal hiding behind her illegal property management company, she will have no mercy on you.

Read the many posts concerning Stewart’s Sharp practice and the intentional privacy violations she has been known to do to tenants she evicts.

When Stewart attempts to photograph your entire unit before your eviction, it is against the LTB Act 2006.Stewart is well known to try and get photos and serial numbers of appliances before she attempts to evict a tenant. Privacy Violators has received several emails complaining that Paul Smith is still entering their unit for Stewart with intentions of photographing every square inch. Make sure your witnesses show and the photos are disclosed in LTB court that she takes.

Landlords can take photos if they pertain to scheduled maintenance and should be noted in the Intent to Enter she will send to you. It is against the LTB Act to photograph a tenants unit or personal belongings in preparation for an eviction. Make sure she produces the photos at the LTB and bring this violation up to the LTB judge.

Remember this : If Stewart is knocking on your door then she is there to evict you for her landlord client. Do not trust anything Catherine Stewart says or signs, it is well known she breaches agreements to make you fight for the funds owed as many tenants have had to do in the past against her.

CATHERINE STEWART DOES NOT HONOR ANY AGREEMENT SHE MAKES OR SIGNS !!

Read the many posts about not trusting Stewart and failing to honor her signed agreement.

  1. Take and post photos of Paul Smith when he attempts to photograph your unit against the LTB rules.
  2. Post the photos of any sent inspector photographing your complete unit on all your social networks.
  3. Record everything Paul Smith (or any inspector Catherine Stewart sends) does and says in your unit.
  4. Have witnesses present when she does enter and photograph your entire unit before evicting you.
  5. Keep detailed notes and all communication received from Catherine Stewart for court purposes.
  6. Hang sheets over walls or cover personal photos, documents before inspector comes. Its your place and can do what you want. you do not have to remove anything and the inspector is not allowed to remove them or open closets, cupboards, fridges or stoves to get serial numbers. bring this up at LTB if she does this.
  7. I would paint the sheets with FUCK YOU before I hung them personally but its your call what you do.
  8. Do not open closet doors for inspector or allow him to do so. Against the LTB Act 2006 for them to do so
  9. Film and record the inspector’s movements with a camera or your phone while he is in your home.
  10. Do not open the fridge, stove or any appliance for the inspector. Against the LTB Act 2006 for them to do so.
  11. The time and date for the inspection has to be noted on the Intent to enter ahe will place on your door.
  12. Stewart is well known for disclosing private tenant information so protect your photos & documents beforehand
  13. Stewart is known for ignoring requests to change date, even interrupted a birthday party to photograph a unit.
  14. Stewart is well known for having her boyfriend, ex OPP Paul Smith sign false statements for landlord clients.
  15. Stewart is well known for protecting Paul Smith from any summons served to them. Read many past posts.
  16. Stewart is well known to break into tenants units without proper legal paperwork to do so.Read POST HERE
  17. Stewart is well known to block all contact from any tenants she encounters, so much for property management

When you go to Landlord & Tenant Board hearing

  1. Ask for disclosure of ALL documents and the Photos taken when you go to the LTB hearing.
  2. Bring your witnesses into the LTB hearing for the judge to hear testimony of this illegal photographing
  3. Mention to LTB judge that Stewart signs illegal name of April Stewart on legal court documents
  4. Mention to the LTB judge Catherine Stewart is legal name and she is a paid paralegal for the landlord
  5. DEMAND DISCLOSURE !! Stewart is known for not giving disclosure or any evidence for any court hearings.
  6. Check LTB main office for any documents she claims to have had signed by Paul Smith or any witness used
    (Catherine Stewart has been alleged and known to have filed false statements and evidence into hearings)
  7. Bring to the attention of the LTB judge she does not fit the definition of landlord under the LTB Act 2006.
  8. Bring to the attention of the duty counsel Stewart is a paralegal and not allowed to represent landlords in LTB.
  9. Serve a summons to the inspector or the (in our opinion) coward ex OPP boyfriend, Paul Smith who knowingly violates tenants rights for his paralegal girlfriend or wife. (undetermined yet). Best place to serve Paul Smith is 117 Bayfield Street, Barrie or their residence in Walters Falls, Ontario.

File complaints with the Law Society of Upper Canada (LSUC)

  1. Report Catherine Stewart to the Law Society of Upper Canada for investigation again.
  2. Send detailed complaint with all the infractions she is bound to breach and use against you.
  3. Publish the complaints online so the public can see the neglect going on at the Law Society intake process.
  4. Send complaints to the local newspaper or local news station to warn the public of this paralegals tactics.
  5. Send us your info, file numbers and photos to publish here for the public to see on Privacy violators website.

If Stewart manages to evict you from your unit, here are some things you can do to retaliate against her and her landlords for infringing on your tenant’s rights. As long as you are the legal tenant on the agreement, all issues concerning the rental unit would go before the Landlord and Tenant Board again, if you decide to show up for them after the fact.

Any damage done to the rental unit while you are in legal control of the unit would have to be addressed in LTB court or a Civil Court to recover any damages if the landlord goes to the expense of hiring a paralegal or lawyer to pursue costs.

If you are on ODSP or on Public assistance you can not be garnished for any reason and money cannot be taken from your government checks. This is something Stewart does not want you to know before an eviction.

The final goodbye to your landlord and Catherine Stewart after she finally evicts you. Do any of these suggestions at your own risk before the last day of your lease or the agreed move out date if any are set at LTB court.

Barrie police informs us that this will continue to be a Landlord and tenant matter until the lease or agreement is up and you move out.make sure to cost the landlord a lot of money for attacking your tenant privacy and evicting you using the illegal methods of Catherine Stewart and Paul Smith. Do not be nice and make your message heard loudly to retaliate against her sharp practice.

 

  1. Remove all the doors and throw them in the city dump so landlord has to spend money to replace them.
  2. Remove cupboard doors and dispose or cut them up so have to be replaced.
  3. Remove locks and dispose of them so landlords have to spend money to replace them for next tenant.
  4. Cut doors, break windows and split shelves in half so they have to be replaced.
  5. Remove windows and throw out in the city dump.
  6. Mess with electrical wiring and fuse box (costly for landlords to fix).
  7. Put cement down the kitchen, bathroom sinks (landlord would have to replace).
  8. Break any floor or wall tiles so the landlord has to repair to make place decent again.
  9. Holes in the wall would need to be repaired before the landlord could rent the unit again.
  10. Put cement in the toilets or pack with towels to block them up so plumber has to be called in to fix.
  11. Put rotten food in the air ducts to be discovered by next tenant (would need to spend money cleaning vents).
  12. Cut cord on fridge, stove and any appliances left (unplug first).
  13. Sell the fridge, stove and any appliance the landlord owns (landlord would have to replace for next tenant).
  14. Sell the washer and dryer if the unit came with one, or make unusable before you leave
  15. Make a hole in the hot water heater so water drains out and burns out the heating element
  16. Make the furnace in-operable, this can be a costly repair for the landlord
  17. Damage stairs or railings so they have to be replaced by the landlord.
  18. Pour paint and shit on the carpets and floors for the landlord to clean up after you leave.
  19. Leave tons of garbage in the unit for them to clean up.
  20. Plug the sinks and turn the water on to over fill sinks and bathtubs ruining the floors.
  21. Remove and dispose of all of breakers in the electrical panel (landlord would have to replace them).

Income support is not subject to garnishment, attachment, execution,seizure or receivership.
Income support is not subject to alienation or transfer by the recipient.
The Director may deduct a portion of income support to recover the amount of a SDO or a prescribed government debt owed by a member of the benefit unit.
Unless the recipient agrees to the remittance of a greater amount, the total amount deducted by the Director and remitted to the Family Responsibility Office (FRO) cannot exceed the amount prescribed under the regulation.
The prescribed amount is 10 per cent of budgetary requirements and 100per cent of any arrears of income
support under the Ontario Disability Support Act, 1997 or any arrears of basic financial assistance under the

Ontario Works Act, 1997 payable to the recipient.

Intent of Policy

To ensure that a recipient’s income support is protected from seizure and garnishment by creditors or transfer to another party to satisfy a debt.

Application of Policy
This policy applies even if the income support has been paid into an account at a financial institution (i.e. directly deposited into a recipient’s bank account).
 Income support is not subject to garnishment, attachment, execution, seizure or receivership.
We hope you never have to resort to any suggestion on these lists but know how frustrating it is going against a crooked paralegal who is now well known for manipulating the courts, the police and the rules of conduct under the Law society of Upper Canada. Landlord Legal owner Catherine April Stewart   Catherine April Stewart of Walters Falls, Ontario has been alleged to have been operating a fraudulent property management firm since 2006 when she became a paralegal and joined the Law Society of Upper Canada and was bound by the rules set out by the LSUC.

Stewart claims on her Landlord Legal website about us page, she sold the property management company in 2006 but obviously lied since she is still known to operate the company from Barrie, Ontario to this day although in conflict with the LSUC rules.Stewart uses an email contact system to screen landlord applicants off of her website.

Catherine Stewart, a licensed paralegal with the Law Society of Upper Canada (LSUC) since 2006, has been known to operate the fraudulent property management company under the name Landlord legal from a small cubicle office located at 117 Bayfield Street, Barrie Ontario.

The property Stewart uses for her conflict of interest paralegal / property management businesses is shared with an account firm and the building is owned by Wendy Kara of Sophia Development Corporation.

The accountants that share the building have been known to receive legal documents that were suppose to be delivered to a secure Legal office but instead ended up in the hands of the other tenants thus unknowingly releasing private and confidential information meant for her legal firm.Another breach of the Rules of Conduct of paralegals for receiving private and confidential legal court documents.

As a licensed paralegal with the LSUC Stewart is suppose to be bound to follow the Paralegal Rules of Conduct set out by the Law Society. Stewart uses her paralegal status along with her property management firm and her boyfriends ex OPP status, private investigator claims and process server company to harass and evict tenants for her landlord clients.

Stewart has been known to file vexatious Civil Court claims in 2013 against Privacy-Violators but abandoned the claims when she filed in the wrong court to have this website shut down for warning the public against her sharp practice tactics against tenants.Stewart will,have to take the matter to Supreme Court of Canada to stop the warnings and publications of her illegal actions and knowingly misleading the Landlord and Tenant Board.

Catherine Stewart has been known to break many of the Paralegal Rules of Conduct, but when Stewart operates the 2 businesses together, they are a conflict of interest according to the Law Society guidelines set out for registered Lawyers and Paralegals.

Stewart has been known to sign April Stewart (not legal name) to legal court documents and then refuses to honor agreements she makes under her fraudulent property management company making tenants she goes after, waste court time, waste tenants money and knowingly breaches the LSUC Rules of Conduct again in doing so. As a paralegal she can not make and sign agreements and then deliberately not honor them costing the other parties monies to collect. This is another complaint put forth in the new LSUC complaints filed against her.

Stewart is known to manipulate the LTB courts constantly and breaches the rules of conduct for her landlord clients.

Diane Smith has been known to work for Catherine Stewart in the past and is a disgraced paralegal who also operated a paralegal firm under different names and failed to show up for the Law Society hearing when complaints were filed against her. Diane Smith sold her house on Masters Drive in Barrie and was alleged to have moved to New Market with her son before the Law Society could catch up with her.

There has been numerous reports of this “SHARP PRACTICE” tactic done by paralegal Catherine Stewart.

   The Canada Revenue Agency, after being contacted by us about possible tax fraud, stated it has no listed business or tax records of Stewart’s property management company she runs in conjunction with her paralegal firm.

There was also no business records or tax records for Paul Smith, Stewart’s alleged ex OPP boyfriend or husband operating a Private Investigator company, and acting as Process Server for over 10 years for his paralegal girlfriend.

Catherine Stewart, who works for landlords only, has also been known to break rules under the Business Act, when Stewart uses two separate names for running her fraudulent scheme.

Catherine April Stewart is also known to call herself a Landlord Advocate and the “Terminator” when she attacks tenants rights that are set out in the Landlord and Tenant Act 2006 and the Human Rights Code.

Catherine Stewart does not fit the definition of a “Landlord” under the act and again is in conflict with the LSUC when she knowingly appears for landlords at LTB hearings.

New complaints have again been filed with the Law Society to look into the Sharp practice tactics, harassment, conflict of interest, false testimony and false evidence submitted by Catherine Stewart in the Human Rights allegations brought up against her and her ex OPP boyfriend Paul Smith, who operated as a Private Investigator when he was not legal or licensed to do so.

We will of course be following the LSUC complaints to see what if anything the Law Society does to protect the public and court participants against illegal tactics of this paralegal who took a 1 year college course to get her paralegal license and manipulates the law and the rules for her landlord clients.

This paralegal definitely puts the Law Society in disrepute with her Sharp Practice and illegal methods.

She (Catherine April Stewart) was adamant. She was going to change the locks and has been doing this job for 13 years and can legally do so and not tell her how to do her job

For over 13 years this paralegal disguised as a property manager has been manipulating the Landlord and tenant Board hearings acting as both the property manager and a paralegal which ids not allowed under the LTB Act 2006. This does not fit the definition of a “Landlord” but she uses the term “Landlord representative” to deceive the LTB courts for the last 15 years when acting as a “Landlord only Rights Advocate” and evicting tenants for her landlord clients.

The Landlord and Tenant Board needs to be aware that Catherine A Stewart has been manipulating the courts and this needs to be addressed and stopped to protect Tenant rights.

The Law Society Rules say she is in conflict of interest using both capacities to manipulate the LTB board and the business act says she should be signing her legal name of Catherine A Stewart when a paralegal acting under her Landlord Legal inc company name.

This self proclaimed “Landlord Rights Only” Advocate is known to use locksmiths like the one owned by Paul Robertson of Barrie, Ontario, Central Lock and Key to break into tenants units because they have no physical address or brick and mortar store in which to serve legal papers to. If you are facing Paul Robertson, call their mobile number and have Paul or Cody come to a vehicle entry or key replacement and serve them when they show for the job. These cowards use many different ways to manipulate the police or the Court system as will be discussed in detail this year.

Catherine A Stewart is also known to use her boyfriend and ex OPP officer, Paul Smith of Walters Falls to enter units to photograph before evicting tenants and signing her Commissioner of Oaths Stamp to statements made by Paul Smith.

Paul Smith is known to act as a process server for the last ten years for his girlfriend and paralegal and is alleged to have given her false documents that she entered into Civil and Human rights Hearings that involved Landlord Legal directly. As an experienced process server Paul Smith should have known when he signed his name to Certificate of services that it is not legally filed until he files his signed statement with the Landlord and tenant Board.

Catherine April Stewart received a Certificate of Service from this ex OPP officer,home inspector,handyman,delivery boy and process server and entered it into evidence for a Human rights Hearing. The North Toronto LTB office had no record of the Certificate of Service he had given his girlfriend when she was defending Ralph Dykstra, Bill Dykstra and Donald Dykstra as a property manager and paralegal.

Paralegal / property Manager..Catherine April Stewart and her ex OPP boyfriend were also named in Human Rights allegations HRTO 17699-14 and the fraudulent documents were also submitted into evidence for their hearing as well as her Dykstra clients.

The Walters Falls resident and Barrie paralegal also refused to take a summons served to the ex cop and her boyfriend Paul Smith when the tenant filed LTB complaints against the “LANDLORD REPRESENTATIVE” as shown above.

 

You can not trust Landlord legal property manager or Landlord Legal inc paralegal to honor any court ordered agreement. The tenant had to take the paralegal and her clients to Barrie Civil court to retrieve an order issue by LTB Judge Sean Henry that was signed by April Stewart acting as the Dykstra’s Legal representative breaking the rules of the LTB Board when she did not fit the Landlord definition as defined by the LTB Act 2006.The order signed by Sean Henry was finally paid by William Dykstra

about 8 months after the order was agreed to by Catherine April Stewart proving you can not trust any of the Dykstra’s and Catherine Stewart no matter what they agree to and sign in court. Please be aware of these tactics constantly used by the Sharp Practices of Landlord Legal while she manipulates the LTB and the Ontario court Systems. Privacy Violators has received many emails of deals made by Catherine Stewart on behalf of her clients and many of the emails received state she did not pay the Court Orders. We will post the additional information we received when the personal Human Rights allegations against this paralegal and the ex OPP officer are discussed in full in our upcoming posts !!

The tenant will take this paralegal back to civil court to waste her time and the Civil courts time to retrieve the Court Ordered payments which she owes and thinks is a joke.

Another Sharp Practice used by abusive paralegals manipulating the legal system for their own gain or her clients gain in our opinion.

Catherine April Stewart has also failed to pay court ordered money when she and her Dykstra clients failed to appear in Barrie Civil Courts and had further lost two motions Catherine April Stewart had brought forward in the civil matters.

April Stewart of Landlord legal is a well known Landlord Rights advocate and runs a small LANDLORD ONLY private property management company who works out of her Walter’s Falls home and a tiny cubicle style office from a connecting corridor between two buildings, owned by Wendy Kara’s of Sophia Development Corporation.The 2 buildings and offices are shared with an accounting company who has been known to accept legal documents on her behalf.

April Stewart is also known as Catherine April Stewart and is known to work as a licensed Law Society of Upper Canada paralegal at the same time. Stewart became licensed with the Law Society of Upper Canada in 2006 and continued to use her legal paralegal authority to her landlord only practice advantage.April Stewart gave herself the SELF PROCLAIMED title of “The Terminator”. April Stewart has been known to call herself an “EVICTION SPECIALIST”. The LSUC has special rules for using such a title connected to her Legal firm and  will be looking into the serious complaints of the “specialist” title she uses for her Landlord Legal property management business when complaints filed are finally heard.

April Stewart of Landlord Legal, has failed to show for illegal entry and illegal lock change allegations that the Barrie police stood by and witnessed on August 15th 2013. The Freedom of Information requests concerning the reports from officer Melanie Beard and officer Turner, the attending Barrie police officers, will be posted when the Human rights allegations against Stewart, Smith and the Ralph Dykstra, William Dykstra and Donald Dykstra of the Dykstra Bros Electric company are dealt with in April 2016.

Catherine A Stewart had filed the VEXATIOUS claims against Privacy Violators to further delay the Law Society of Upper Canada complaints filed by the ex tenant of Dykstra Bros Electric.

April Stewart as a property manager is a publicly known LANDLORD ONLY ADVOCATE who has been known to break the rules of the Law Society on many occasions while working as a property manager for her Landlord only clients.

Landlord Legal closed the 44 Sykes Street, Meaford office after only one year after expanding her small Barrie office to the Meaford office. The owner of Landlord Legal failed to notify the human Rights tribunal of the office closing, knowing the address was on file for the Toronto Human Rights Tribunal Ontario allegations against Catherine Stewart of Landlord Legal, her boyfriend, ex OPP, Paul T Smith and her Dykstra Bros Electric Barrie clients, William Dykstra, Donald Dykstra and William (Bill) Dykstra.

The ex tenant has asked the LSUC to hear the complaints of the illegal break in and failing to show for the allegations and further failed to notify parties of her intent to NOT SHOW. Stewart sends another paralegal in her place to lie for her in court, claiming she is “out of the country”. Stewart never has to prove these statements because she refused to show for the break in allegations after the officer’s that witnessed the events were present at the September 2013 Landlord and Tenant Board hearing for her Dykstra Bros Electric clients, Ralph Dykstra, William Dykstra and Donald Dykstra.

Disgraced paralegal Diane Smith (shown at left) failed to show at the Law Society of Upper Canada hearing to determine if she was practicing law in Barrie Ontario in 2013, without being properly licensed to do so by the Law Society of Upper Canada.

Diane Smith has been known to work with Landlord legal property management prior to her being disbarred from th LSUC in 2013. Paralegals and what is known as “SHARP PRACTICE”

This post refers to the term “Sharp Practice” in relationship to the Law Society of Upper Canada (LSUC) Rules of Conduct, for paralegals and lawyers, refers to and occurs when the LSUC licensed parties use methods to abuse the process of legal proceedings that are not following the rules of the Law Society, not warranted, not standardized or legal, meant to hide their clients and disrupt or delay ANY legal proceedings or ANY COURT matters they are involved in !!.

Sharp practice is a pejorative phrase to describe sneaky or cunning behavior that is technically within the rules of the law but borders on being unethical

Gaming the system (also referred to as gaming the rules, bending the rules, abusing the system, cheating the system, milking the system, playing the system, or working the system) can be defined as using the rules and procedures meant to protect a system in order, instead, to manipulate the system for a desired outcome

Legal abuse refers to abuses associated with both civil and criminal legal action. Abuse can originate from nearly any part of the legal system, including frivolous and vexatious litigants, abuses by law enforcement, incompetent, careless or corrupt attorneys and misconduct from the judiciary itself.

Legal abuse is responsible not only for injustice, but also harm to physical, psychological and societal health

Vexatious litigation is legal action which is brought, regardless of its merits, solely to harass or subdue an adversary. It may take the form of a primary frivolous lawsuit or may be the repetitive, burdensome, and unwarranted filing of meritless motions in a matter which is otherwise a meritorious cause of action. Filing vexatious litigation is considered an abuse of the judicial process and may result in sanctions against the offender.

A single action, even a frivolous one, is usually not enough to raise a litigant to the level of being declared vexatious. Rather, a pattern of frivolous legal actions is typically required to rise to the level of vexatious. Repeated and severe instances by a single lawyer or firm can result in eventual disbarment.

SHARP PRACTICE is frowned upon by the Law Society of Upper Canada Rules of Conduct.Many Paralegals and Lawyers use Sharp Practice in their legal firms participation in the legal system further causing back logs of legal proceedings needlessly in defense of their firm or their clients.

Examples of Sharp Practice, is not showing, or notifying parties, using acting agents, locksmiths and other parties related to their cause, that have NO PHYSICAL BUSINESS ADDRESS anywhere, to deliver Court Summonses when they are, or clients are involved in legal proceedings.

Remember SHARP Practice = do whatever it takes, does not matter if they present at, or commit a criminal act, the LSUC rules, the Criminal Code, PIPEDA, Chart Rights, Human Rights or the Rules and procedures in any court proceeding you or your client are involved in.

Eviction Specialist, C A Stewart of Landlord legal inc, uses agents or sub contractors companies like Paul Richardsons’ Central Lock & Key, that has NO BRICK & MORTAR STORE, to enter tenants units, change locks and other duties she needs done. Central Lock & Key were hard to get a summons served to, as they are MOBILE UNIT ONLY and Mr Richardson son, Cody Richardson threatened the tenant. and tried to hit his vehicle with the Central lock & Key company van while attempting to serve them summonses for Superior Court Civil matters.

Paul Richardson saves a phone recording for 2 years from attempts to get him served for LTB matters in 2013, and lies about the date of the recording, and plays it on the witness stand to allegedly deceive the court, and help C A Stewarts Dykstra clients in court.

Using “acting agents” or “sub contractors” that are next to impossible to summons, or that paralegals can block access to, is a very common practice done among paralegals and lawyers who practice SHARP PRACTICE frowned by the LSUC.

Paul T Smith ends up on the stand in civil court Dec 2015, for C A Sewarts Dykstra clients, although he is connected to breaching Human Rights while acting as an agent for Landlord legal and Dykstra Bros Electric,  and had absolutely no knowledge of the allegations in her Dykstra clients proceedings.

The SCC1851-13 civil matter filed by C A Stewart is still pending, as Stewart has taken NO ACTION after being told it was IN THE WRONG court.

The hash tags #Black lives matter and #All lives matter have been the public issue and in the news over the last couple of years.No matter what your race,creed,religion, or background we are suppose to have protection from the wrong doers in today’s society.

All lives matter is not something that Renu Mandhane, head of the Human Rights Commission, can say about the Human Rights Tribunal of Ontario, located at 655 Bay Street, where they operate their Mickey Mouse HRTO court system in Toronto, Canada.

The Human Rights Tribunal of Ontario (HRTO) is run by Registrar Richard Hennessy and is suppose to have lawyers, acting as impartial mediators when dealing with Human Rights allegations brought up to the Tribunal to be heard.

The HRTO constantly breaches its own mandate when dealing with issues brought forth by Canadian citizens who attempt to right the wrong done to them concerning violating their Human Rights in Canada.

Barrie Chronic Pain Clinic discloses patients private information !

The Barrie Chronic Pain Clinic, is a privately held company located in Barrie, Ontario, Canada and is categorized under Family Practice Doctors.

The location of this pain clinic has moved and changed over the years, but has most recently set up their little practice with multiple doctors sharing a few very small offices at 500 Huronia Road, Suite 101 which is now located in the basement of the building.

The clinic provides a very small 9 x 9 waiting room with six hard back chairs for their chronic pain patients to sit on while the wait times are routinely ridiculously long. The clinic is well known, to over book patients so as to charge OHIP the maximum they can for the small shared office spaces shared by the many doctors.

The Barrie pain clinics operating hours are Tuesday to Friday, 10am – 2 pm, with each of the listed doctors sharing and billing for use of the 3 small rotating offices. The clinic is alleged to care more about maximizing their profits than committed to patient care or service to the chronic pain patients they serve.

This Barrie pain clinic is primarily operated under medical Director, Dr Constantine “Gus” Zachos.

Other doctors that share these small offices on a part time basis to cut their operating costs are Dr Paul Perlon, Dr Richard Goudie, Dr Reza Heidarpour Heymeh, Dr James Ku, Dr Michael Partridge, Dr Seyon Sathiaseelan, Dr Joey Rampton and Dr Mitch Whyne.

The clinic has a financial interest and is associated with Mary Dove yoga, which is located in the basement just up the hall from these doctors offices, and has shared confidential information with the private yoga instructor running it, many times without patient knowledge or consent.

Recently we received emails stating complaints were to be filed with the College of Physicians and Surgeons located in Toronto, concerning the lack of care and compassion against Dr Paul Perlon of Richmond Hill and Dr Zachos, the Director the Barrie Pain Clinic for violating patients’ rights as well as disclosing confidential medical information without patient consent or knowledge.

Dr Paul Perlon, is known to have a clinic in Richmond Hill and also an emergency room doctor. Many complaints have been received concerning Dr Paul Perlon over prescribing the narcotic, Oxycontin and Oxyneo.

The neglect for the addiction factors and safety of his patients under his care, along with the safety of the public, when he prescribes large amounts of Percocet and Oxycontin to his patients he administers nerve blocks to, have been noted in the complaints to the College of Physicians and Surgeons.

Dr Perlon has been known to allow heavily prescribed patients to continue to operate motor vehicles and maintain jobs at dangerous positions & factories around Barrie and Richmond Hill, when the nerve blocks he administers do not work.on other reviews, Dr Perlon is alleged to be sexist when it comes to his female patients and seems to have less compassion or care for them according to reviews on the website RateMds.com

The complaints that are filed with the College of Physicians, are to be forwarded to aware OHIP, and the Minister of Health, Dr Philpott of the dangers Dr Perlon, Dr Zachos and the Barrie Pain Clinic pose to public safety and scrutinize their billing practices to the government for the services they provide.

The new legislation regarding cutting back and prescribing highly addictive narcotics like, Oxycontin by doctors, surgeons and pain clinics will help keep the addiction rate lower, workers safe and heavily drugged patients off the streets.

Many provinces have seen an increase in overdoses and vehicular deaths caused by strong narcotics like Oxycontin and Fentanyl needlessly prescribed so doctors and pain clinics can make a larger profit.

Diane Lynn Smith of Barrie practiced law illegally under several names !

Law Society of Upper CanadaThe complaints to the Upper Law Society of Canada, against Diane Smith of Smith Paralegal Services, were originally filed on June 8th 2013.

A Barrie tenant alleged that Diane Smith had harassed him by sending a letter representing herself as a legal “lawyer” and representative for Nancy Groves, when she was not legal to do so.

In the complaint to the Upper Law Society of Canada (ULSC)  it had come to light that Diane Smith had been practicing law, but her Paralegal license was not in good standing with the ULSC for her to do so.

It was also determined that Smith Paralegal Services was engaging in professional misconduct when she harassed a tenant who was involved in several pending court cases with his landlords and had sent the letter that made references to her fees as “Attorney fees”.

Upon filing a civismithl claim in Barrie against Smith paralegal Services, an investigation has revealed that Diane Smith had been advertising and practicing law in Ontario under the name Diane Merry Paralegal Services, with the same address and cell number that had used in her other law practice.

There are no records for Diane Merry of Merry Paralegal Services, 58 Masters Drive, Barrie listed in the Upper Law Society of Canada   “Lawyer and Paralegal Directory“.

Diane Smith DID NOT APPEAR before the ULSC panel to answer for the allegations against her and now appears to be hiding her assets, knowing the outcome of the ULSC allegations and pending lawsuits filed against her.

A paralegal firm owned and operated by Catherine April Stewart of Landlord Legal inc has been in our website news since May of 2013, when April Stewart of landlord Legal inc was hired to evict a tenant of Ralph Dykstra, William Dykstra and Donald Dykstra of Dykstra Bros Electric of Barrie.

The tenant in question had a valid Medical Marihuanna license to possess and grow his own medical marihuana as well as signed permission from the three Dykstra Brothers themselves but was forced to file allegations in Human Rights against Ralph Dykstra, William Dykstra, Donald Dykstra, Catherine April Stewart and her alleged boyfriend,process server and private investigator Paul T Smith when they attempted to evict him from his 40 Ellen Street Barrie Ontario apartment.

Landlord Legal inc had moved her files and set up another office at 44 Sykes Street N Meaford, Ontario with the help of her alleged boyfriend, retired OPP officer, process server and private investigator Paul T Smith, in June of 2013, but recently closed her Meaford office in June 2015 with the allegations against her and Paul Smith in Human Rights.

Catherine Stewart of Landlord Legal failed to notify the Human Rights Tribunal of the office closing as per the Rules of Procedure during the proceeding.The tenant had notified the HRTO of the fact when he had tried to serve legal documents to the address on file and discovered it was closed.After talking with other commercial business close to her closed office, the process server discovered it was closed in June 2014, one year after she opened in Meaford,Ontario.

An “ORDER DURING A PROCEEDING” has been requested and submitted to the Registrar in the HUMAN RIGHTS ALLEGATIONS for Paul Smith and Catherine April Stewart of Landlord Legal inc to PROVE the existence of documents Stewart has claimed to have filed with the Toronto Landlord & Tenant Board, North office back in May 2013.

Allegations of entering false testimony and evidence arose during the Dykstra civil trial, as well as the Human Rights during a summary phone conference with Paul Smith and Catherine Stewart when they submitted a “certificate of service” from the May 2013 “intent to enter” into their response to the Human Rights allegations against them.The Toronto North LTB office supplied copies of ALL files to the tenant, on record for all incidents,including May 2013, but failed to locate the document Landlord Legal provided to the tribunal when tracking documents, to three different departments and three different managers was submitted.

As of August 15th, 2015, Landlord Legal inc has not provided the proof requested but stated in an email to the Registrar, they would provide proof if directed by him to do so. There has been NO movement on this serious allegation of entering false evidence and statements into a court hearing or tribunal.

The Law Society has also been requested previously by the ex tenant to investigate the false evidence allegations, the illegal lock removal and entry by Dykstra’s and their representative C A Stewart of Landlord Legal inc of Barrie as well as a dozen more allegations of un professional conduct, breach of an order and numerous civility complaints .

Catherine Stewart and Paul Smith first claimed the existence of the alleged documents during his testimony on the stand at the Dykstra civil trial when Stewart placed him there without disclosure, without proper will says or PAUL T SMITH name on the proposed witness list.

Landlord Legal has of September 2015, not informed the Human Rights Tribunal of the changes in her business address for the representation of her clients, Dykstra Bros Electric set for a hearing on January 20th 2016 or for the Human Rights allegations brought against Paul Smith and herself which is still awaiting a hearing date.There has been a long history of allegations of harassment , un necessary court delays, several abuses of the court system and many other allegations that are still pending and awaiting investigation.

C A Stewart contacted the Law Society claiming there are pending court actions involving herself and the tenant which has stalled the allegations into being investigated.It has been 2 years since this was filed in Barrie Civil Courts on October 22nd 2015 and the case of Stewart vs Ross has yet to have a hearing.

Catherine Stewart has not informed the Law Society of Upper Canada of the pending Human Rights allegations that were filed against her in May of 2014 and now pending for a hearing January 20th 2016. The paralegal was also involved with a Landlord and Tenant hearing in September 2013 along with her Dykstra clients allegations of illegal entry and illegal lock change but did not show for the hearing sending another paralegal, stating she was out of the country but FAILED TO NOTIFY THE OTHER PARTY OR PROVE HER CLAIM.

To date, Catherine Stewart of Landlord Legal has filed numerous FALSE ALLEGATIONS with the Barrie police concerning the ex tenant, all to be listed with the related video from the Barrie detective Sgt Steele investigation and all the incident reports from the involved Barrie Police officers and Landlord Legal inc., in another related upcoming posting.

The BBarrie policeBarrie police have numerous times REFUSED the ex tenant to file CRIMINAL HARASSMENT CHARGES against this paralegal after he tried several times to file complaints against her for the numerous false reports she has continued to file. A further complaint to the Law Society is still pending on these harassment grounds, as she was well aware the allegations were false and of the pending civil and Human Rights hearings with this ex tenant she was and is still involved in.

The Barrie Civil Courts have continued to ignore this citizens rights when on July 11th 2014, the tenant motioned for a speedy trial,the civil court has also prejudiced and ignored the rights of this individual when it stripped his rights to serve legal documents in ways addressed in the Rules of Civil Court Procedures and ordered that documents only be served by email without probable cause or justifying its reasons.

Judge Kalowski further breached the Rules of Civil Procedures when he took Catherine April Stewart into his chambers after a scheduled motion without the other side being present, stating “it was on an unrelated matter”, but Catherine April Stewart stated in court on that day “it was her first time in Civil court”, again showing the prejudice of Judge Kalwoski and the Barrie courts.

A pending complaint to the Law Society to investigate the allegations of civil court Judge Kalwoskis breaches of the rules and discrimination and violation of his rights towards the Barrie citizen.Transcripts of that Motion Hearing will be presented to the Law Society for an investigation into these allegations.

IT IS TRULY A MESSED UP SYSTEM WITH THE  LAW SOCIETY OF UPPER CANADA INVESTIGATION, WHEN SERIOUS ALLEGATIONS, ARE DELAYED FOR YEARS, WHEN THE OFFENDING PARALEGAL ONLY HAS TO FILE ANY FALSE CLAIM IN COURT, THEN DELAY THE PENDING COURT ACTIONS INDEFINITELY !!

Privacy Commissioner of Canada findings to “Marihuana Medical Access Program” Privacy Incident

privacy-commissioner-canadaA complaint under the Privacy Act, that was filed against Health Canada (HC), by this author and 338 other complainants that took the time to stand up for their rights, has finally been concluded and a detailed lettered response dated March 3rd 2015, has been received after nearly a year and a half waiting.

 

The office of the Privacy Commissioner of Canada ((OPC), investigated why the Health Canada “Medical Marihuana Access Program” (MMAP) had sent out 41,514 letters on November 21st, 2013 to clients who received the mail out and were very concerned that the full name of the program was legible through the openly visible windowed envelopes they received, as well as displaying the name and address of the participants involved with the MMAP.

 

The letter, signed by Daniel Therrien, Privacy Commissioner, and dated March 3rd 2015 was sent to this author and is shown below and states that;

Following the investigation into this incident,we have concluded that the matter is well founded.

1. This Report Findings relates to a Commissioner-initiated complaint under the Privacy Act “the Act” against Health Canada (HC). It relates to the mailing 0f 41,514 letters using windowed envelopes to “Marihuana Medical Access Program” (MMAP) clients that allowed the name of the program to be openly visible.

 

Background

2. On November 21st 2013, HC posted a notice on its website from the Deputy Minister stating that the department had “recently sent approximately 40,000 informational letters to individuals with an interest in upcoming changes to the Medical Marihuana Access Program (MMAP)”. It further stated that ,”as a result of an administrative error the envelopes were labelled to indicate that they were sent by the program. This is not standard Health Canada practice.

3. The Office of the Privacy Commissioner of Canada (OPC) determined that there were reasonable grounds for a Commissioner-initiated complaint against the department.

4. Accordingly, the OPC initiated a complaint

August 15th 2013 – Paul Richardson and his son Cody Richardson entered the 40 Ellen Street Barrie unit illegally and proceeded to change the locks on orders from Catherine Stewart and in front of 2 attending police officers and without any court papers or legal papers of any kind picked the bottom lock and cut the security chain to gain entry illegally.

Central Lock & Key of Barrie were called to 24 Victoria Street by Catherine Stewart of Landlord Legal, and the owners of the units Dykstra Bros Electric for a legal Sheriffs order they had for the unit nut admitted on the stand at the civil hearing that none were provided to them when they illegally entered 40 Ellen Street August 15th 2013.

 

Paul Richardson and his son Cody Richardson of Central Lock & Key has worked for 4 -5 years on several occasions with Catherine Stewart of Landlord Legal changing locks, according to the owner Paul Richardson, on the stand March 12th 2015.

Paul Richardson of Central Lock & Key has no fixed store address for this locksmith service and has no business license and no records with the City of Barrie to operate a business in Barrie. He runs a van as a mobile unit set up with equipment to change and make key & lock changes.It makes it hard to find and serve locksmiths set up like this as summons have to be given in person so we want to help other people that need to find this business for what ever their reasons are and this is probably the reason Catherine Stewart uses locksmiths like Paul Richardson Central Lock & Key for her eviction and lock removal processes.

In October 2013 Paul Richardson and his son Cody Richardson, along with Barrie police officer Melanie Beard, were summoned to the LTB hearing which Catherine Stewart of Landlord Legal inc had claimed to be out of the country for and Stewart had also failed to notify the tenant or the LTB tribunal of her intentions although she had plenty of time she was notified before the trial and had the contact information for the tenant in the court files.

Paul Richardson, the owner of Central Lock & Key did show up at the civil trial and on the stand became a hostile witness when he had to admit he was directed to enter the unit illegally by Catherine Stewart of Landlord Legal inc and asked the judge to listen to an audio recording he had taken.

Paul Richardson had saved an audio recording (18 months on his phone) from the September 2013 LTB hearing summons when the tenant had told him if he co operated he would not write badly about the deeds he had done illegally August 2013th on Catherine Stewart’s direction as the tenant knew they were manipulated as were the Barrie police. When asked on the stand when the audio was taken, Paul Richardson had lied, when he said he did not know when it was recorded, although it was evident from the recording it was from 18 months prior for the September 2013 LTB attempts to summon him for the LTB trial that Catherine Stewart and her clients failed to show or to notify the LTB Tribunal or the tenant involved.

Stewart and her clients failed to show for the “Mandatory Settlement Conference” for the civil cases she filed against the tenant. These allegations were finally heard March 12th 2015 and the judge hearing the case “Reserved Judgement” and we will post the results and the orders whenever we finally receive them.

Canada Revenue Agency fires 14 employees, suspends 18 more for privacy violations

The Canada Revenue Agency ha fired 14 employees and suspended another 18 more employees over the past year for unauthorized access of computer files as the agency responds to criticism that it isn’t doing enough to protect the privacy of Canadians.

News of the disciplinary action comes on the heels of a damning audit report last fall by the federal privacy commissioner. Auditors found managers were unaware that some Canadian Revenue Agency (CRA) employees had been inappropriately accessing records from thousands of taxpayers for years undiscovered.

“I think the numbers do reflect that we take the problem quite seriously and that we do follow through when incidents do occur,” said Susan Gardner-Barclay, the Assistant Commissioner of the CRA, without providing any further details on the CRA employee firings and suspensions.

Eight former CRA officials have been charged in connection to a six-year corruption investigation by the RCMP, which announced the end of the probe in February.

Senior CRA officials were testifying Tuesday as part of a broader study by the Commons committee on Access to Information, Privacy and Ethics into concerns over identity theft. The agency was on the defensive over its approach to data breaches by mail.

The agency confirmed that over 2,983 data breaches took place in 2013 – almost all related to mail going to the wrong location – and that 46 per cent of those cases involved personal information. Yet the CRA acknowledged that the vast majority of taxpayers who have had their information sent to the wrong place are never made aware of the breach. Further, the CRA only told the privacy commissioner about 479 of the breaches.

Ms. Gardner-Barclay said the agency’s decisions on whether or not to inform taxpayers or the privacy commissioner about a breach are based on an internal risk assessment used to determine the seriousness of the release.

The CRA said it reclaims about 95 per cent of mail that was sent to the wrong place, but also acknowledged that it can only measure breaches that have been reported back to the agency, meaning the true numbers could be much higher.

Officials said one of the main causes of data breaches is because automated mail sorters place letters meant for two separate addresses into a single envelope.

“It’s usually a machine error,” said Ms. Gardner-Barcley, explaining that virtually all mail has been automated. “It’s very rare that we would be putting documents in envelopes by hand.”

NDP MP and committee member Charmaine Borg – who has dealt with a constituent who received mail from CRA meant for someone else – said Canadians should be told when their information has been breached.

The NDP had previously asked through a written request in Parliament for data on all breaches going back to 2006, however the CRA said it only began tracking such statistics last year.

“I think it’s very concerning,” she said after the meeting, arguing the CRA should be forced to inform Canadians whenever there is a breach. “As a Canadian, you give your information to the government and you should have faith that the government is going to protect that information. But to not even be aware of when your personal information was breached or put at risk? It’s a problem in my view.”
