In all the 5 years legally MMAR licenced, I personally never had an issue with anything until Ralph,Don and Bill Dykstra disclosed PRIVATE and confidential information to another long time family friend and tenant. Royal Lepage Reality of Barrie, Ontario has been discovered to have not been revealing that property and houses
owned by Ralph Dykstra, William Dykstra and Donald Dykstra located at 24 Victoria Street and 40 Ellen Street Barrie Ontario were used for marijuana grow ops as paralegal Catherine Stewart states in her Barrie Civil Court claim against an ex tenant with a medical marijuana growing license issued from Health Canada.
February 2011 seen a drug raid by the Barrie City Drug Enforcement at 24 Victoria Street which seized over 100 marijuana plants and had arrested the tenant, Manny Portelli for illegally growing marijuana. The damage to the house was extensive as well as the marijuana smell, black mold and other damages.

Page 7 of the FOI is Landlord Legal false statements to the Barrie police concerning the tenant legally allowed to grow medical marijuana and approved by Ralph Dykstra, William Dykstra and Donald Dykstra of the former company Dykstra Bros Electric (now Gerard Dykstra Electric of Barrie, Ontario) after ex OPP officer, Paul Smith, enters the unit and photographs every inch in preparation for an eviction. This is against the Rules of the Landlord tenant Board as is a paralegal acting as a property manager representing the Dykstra’s in Barrie LTB. (Discussed in future posts in detail)
There was no professional clean up done to 24 Victoria Street but the three Dykstra owners, Ralph Dykstra, Bill Dykstra and Donald Dykstra chose to cover this up when they put the property on the market soon after the drug raid.
July 2014 seen a tenant evicted from 40 Ellen Street, Barrie, Ontario, when Walters Falls paralegal disguised as a Barrie property manager, Catherine A Stewart used her ex OPP boyfriend, Paul Smith, also of Walters Falls to enter the unit and photograph every inch with all the appliance serial numbers and tenants personal items and property in preparation to evict him.
Catherine Stewart of Landlord Legal inc. files a civil claim against the legal marijuana grower living at 40 Ellen Street for nearly 5 years and mentions her having to file the units with the MARIJUANA GRO OP REGISTRY in her statements in the Dykstra’s Civil Cases but fails to have the two houses listed as a potential Health risk in the GRO OP REGISTRY with warnings to future buyers of the Dykstra Bros 24 Victoria Street and 40 Ellen Street properties.
The Dykstra’s had originally given written authorization to the tenant to allow the marijuana gro op but after another tenant, Nancy Groves, got involved, Human rights allegations were filed against the 3 Dykstra brothers and the paralegal / Property manager, Catherine April Stewart along with her boyfriend and ex OPP officer Paul Smith. The tenant was allowed to grow upwards of 60 medical marijuana plants with a license issued from Health Canada before the program was shut down by Health Canada and Constitutionally challenged in the Supreme Court.
Catherine Stewart filed a Civil claim for $25,000 for damages against the ex tenant after she evicted the legal medical marijuana tenant for her clients Ralph Dykstra, William Dykstra and Donald Dykstra of Barrie Ontario.
Catherine April Stewart is also known to file vexatious claims against Privacy Violators but failed to appear many times, dragged it on for 2 1/2 years in the wrong court and stated she was going to take her issue to Supreme Court, but neglected to do so.
The Barrie Civil Court ignored the Speedy Trial request which was upheld in one motion but ignored and proceeded for 2 1/2 wasted years without a single trial but many motions against her methods used during the course of her wasting the Civil courts time.
The Civil Court has no jurisdiction to shut this website down or make any demand for any posts to be removed without a proper court order.Barrie’s Civil Judge Kalwosky takes the paralegal, Catherine Stewart to his chambers during court proceedings, but neglects to have the opposing parties attend the meeting. It is further alleged Judge Kalwosky had made notes in the courts files against the tenant after he had discussed matters in his chambers violating the rules in the Justices Act for presiding judges. Another corrupt man in the Barrie Civil court system in our opinion !! We are still searching for a photo of Judge Kalwosky to post online with the allegations but will posts his ruling from the motions brought forward from the tenant.
If Catherine Stewart wants any article on Privacy-Violators.com modified, she did not contact us to do so or file her claim in the Supreme Court since August 2014.
The Speedy Trial requested of the Barrie Civil courts should have ended the paralegals attempts at wasting valuable courts time for her and her ex OPP boyfriends, Paul Smiths own interests.The corrupt Barrie court system allowed this paralegal to waste many valuable hours of courts time which would have better served with real cases before the courts.
The son, Gerard Dykstra, of 94 Cardinal Street, Barrie, was one of the Dykstra’s that was using the long established Dykstra Bros Electric company name but soon changed his company name to Gerard Dykstra, Licensed Electrician after the Human Rights allegations were filed against the three older Dykstra’s including his father.

This new “Tenant Rights” advocate has just begun to discuss the injustice in our system and the Law Society of Upper Canada ignorance of the peoples rights when they need to be protected from people like this.
In well documented court battles on our website, that lasted three years and went from 4 Landlord and Tenant Board hearings in 2013 to vexatious civil cases in 2014 being filed, to the 2 Human Rights allegation hearings brought against Ralph Dykstra, William Dykstra and Donald Dykstra of Barrie’s Dykstra Bros Electric and ex OPP retired officer Paul T Smith and his paralegal / property manager girlfriend Catherine A Stewart there has been no mention of their claims it was listed in the Marijuana Grow registry as stated in civil court by Catherine Stewart of Landlord legal inc.
The home at 24 Victoria Street was raided May 2012 and found over a 100 marijuana plants growing in the basement. The young mother, Diana T had several young kids living there and was left with the mess to clean up after Dykstra’s did nothing about the mold and mess left after the grow op was dismantled bagged and taken away. The home at 24 Victoria Street has been listed for sale by the owners, Ralph Dykstra, William Dykstra and Donald Dykstra of Dykstra Bros Electric and has been listed by a realtor working for Royal Lepage, with no mention of the May 2013 marijuana bust or the excessive mess and mold problems left after the grow op dismantled.
The Dyksta’s also own 40 Ellen Street, Barrie Ontario that was used by the tenant that lived there to grow legal medical marijuana for disability purposes. There are many posts on Privacy Violators website that discuss the methods used by Catherine Stewart of Landlord legal during the legal battle to have the tenant evicted. The tenant had filed Human Rights allegations against Dykstra Bros Electric and Landlord legal after his Human rights were violated.
The Human Rights Tribunal hearing, mediation, evidence and testimony entered by Catherine Stewart of landlord Legal inc is discussed in detail to educate the public on the lies told by the HRTO and the alleged methods unbecoming a paralegal that are being filed again for a complete investigation by the Law Society of Upper Canada by the ex tenant. Did Royal Lepage know ahead of time the units were gro ops, yes indeed, the ex tenant had sent a letter to them when he was evicted and Catherine Stewart stated in court the damage done and the mold issues and how the Dykstras had to now list the homes as potential dangers to the buyer but continued to list the properties.
Privacy Violators sent a potential home buyer to the home listed by Royal Lepage to see if any details of the marijuana bust or gro ops would be mentioned by the selling realtor, and it was not brought up by the realtor at all.We will be releasing the interview about the buyer, details that were discussed and his overall feelings of purchasing a marijuana gro op house.

Human Rights allegations filed against Dykstra Bros Electric for discrimination against tenant Medical Marihuana grower
The Human Rights Tribunal of Ontario (HRTO) received an application that was filed December 2013 from an ex tenant of Dykstra Bros Electric concerning alleged medical marihuana privacy violations and discriminating against him to restrict him to grow four (4) plants when legally licensed in excess of the 4 plants they claim.
Dykstra Bros Electric of Barrie, Ontario owners involved with past ex tenant disputes in Landlord & tenant tribunal, pending civil court proceedings and Human Rights allegations brought against them.
Another Human Rights application was filed May 2014 by the ex tenant, against Landlordlegal inc and her acting agent Paul Smith for alleged Medical Marihuana privacy violations and discrimination.
* If Catherine Stewart of Landlord legal inc is found guilty of Human Rights violations she will lose her paralegal license and not be allowed to practice law again.
The Human Rights claim is for discriminating against him for not allowing him to grow more than four (4) plants when he was licensed for an excess of that amount and was growing within his given license requirements legally. It is also states claims of Medical Marihuana Access Program privacy violation issues plus threats of reprisal, acts of reprisal, harassment plus the illegal reasons stated in the N5 that Stewart attempt to evict him on un Constitutional grounds.
The court hearings between the tenant and Dykstra Bros Electric started back in May 2013 when the tenant had taken the landlords, Ralph Dykstra, William Dykstra and Don Dykstra to the Barrie Landlord and Tenant Board tribunal for discussing private, confidential Health Canada Medical Marihuana Access program information with their very long time family friend and tenant, Nancy Groves.

The LTB tribunal hearings did not end in May between the tenant and Dykstra Bros Electric with a simple apology.Nooooo
Ralph Dykstra, William Dykstra and Don Dykstra of Dykstra bros Electric decide to hire Catherine April Stewart of Landlord Legal inc on May 13th to evict the tenant.
On May 23rd 2013,Landlord legal inc or one of her agents posted a letter on behalf of her clients, the Dykstras, openly displaying private and confidential Medical Marihuana Access Program (MMAP) information concerning the tenant along with a “24 hour Intent to Enter” notice.The letter further demanded the tenant produce MMAP license information to her agent that was to perform the “Routine Maintenance” as she claimed in the 24 hour the intent to enter notice.
Paul Smith, acting agent for Landlord Legal entered 40 Ellen Street, Barrie for the notice, though a letter was given to Landlord Legal at Catherine Stewarts old Barrie office at 117 Bayfield Street, the same morning as receiving her notice and revealing letter explaining a birthday party was already scheduled.

The inspection was done in spite of the tenants birthday party and in front of the tenants remaining guests from the scheduled birthday party. The tenant filed another LTB hearing CET #31816-13 against Dykstras and their agent for harassment and disclosing the confidential MMAP information and had a June 27th hearing date set to hear the complaint.
Landlord Legal inc had sent a DO NOT CONTACT her or her clients or TRESPASS on the properties of Landlord Legal inc and her clients, the Dykstra brothers, to the Community Legal clinic in Orillia, Ontario
C A Stewart refused to provide copies to the tenant of the “Routine Maintenance”, inspection report or copies of the photos that her acting agent Paul smith had taken may 24th 2013 in written or email requests.
Catherine Stewart of Landlord Legal inc refuses the summons from Barrie police, whom she had called on the tenant on false pretenses, for her agent Paul Smith.
Catherine Stewart of Landlordlegal inc does not fill out the N5 properly identifying other cases, past or present that were related to her application and before the Landlord & Tenant Board tribunal. The tenant had previous and pending hearings related to her N5 application.
Catherine Stewart files an N5 ” Notice of Early Termination” on grounds the tenant would not produce the Health Canada MMAP information she demanded in her letter and refused to give an un blocked copy to Paul Smith, who asked for the license information without any authority to do so and in front of the tenants guests. The tenant was posting all of his LTB hearing information following his adventures through Landlord and Tenant tribunal complaints against the paralegal and her clients and Stewart wanted the postings stopped and this website shut down.
Case is mediated by LTB mediator Dawn Lewis, Community Legal clinic paralegal Howard Tavroges ( NO LONGER WITH ORILLIA LEGAL CLINIC, though his current Upper Law Society of Canada profile still shows the Legal Clinic phone number and fax) the tenant and Catherine Stewart.
The mediated agreement order was to return last months rent and tenant would voluntarily move out on August 15th 2013 to file his Human Rights claim in peace and his living environment was already poisoned from the Dykstras revealing his confidential MMAP information.
** On move out day, August 15th 2013, Catherine Stewart of landlord Legal and her clients were present at the tenants 40 Ellen Street, Barrie, Ontario residence and called Barrie police on false pretenses to the unit to watch Catherine Stewart and her clients instruct Central Lock & Key of Barrie to break the front door lock, cut the security chain and enter the unit to change the locks.
** Did we mention that the tenant was moving out already voluntarily and had a court order that instructed Landlord Legal to apply for a Sheriffs order if not vacated as per agreement. Dykstra Bros Electric did not want to honor the agreement they made in LTB court July 18th 2013 and signed by Catherine Stewart with full authority to do so from William Dykstra, the only Dykstra brother present in court.
No Walkthrough on August 15th 2013! No Rent Returned On Vacancy ! No intention of honoring July 18th LTB Order !

The tenant files another LTB complaint CET #33911-13 against Catherine Stewart of Landlord legal inc and Dykstra Bros Electric for harassment and the illegal entry and lock removal incident on August 15th 2013
Catherine Stewart and her clients FAIL TO APPEAR for the hearing date set and DOES NOT NOTIFY the tenant, summoned witnesses or the LTB courts before the hearing.
Barrie police officer M Beard was summoned and present for the hearing as was Central Lock & Key owner and his employee and another witness that was in the unit at the time they forced themselves into the unit without proper documentation to do so.
Stewart sends another paralegal to claim she is out of the country and the judge orders Stewart prove he claim when the hearing is rescheduled again.
The tenant has pending court actions against Central Lock & Key for the break & enter and the Barrie Police department for the tenants rights being violated as they stood by and watched knowing Catherine Stewart did not have any legal documentation for what she instructed the locksmith to do.
The tenant has also written the Upper Law Society of Canada over paralegal, Howard Tavroges involvement with Catherine Stewart of Landlord Legal in LTB tribunals in Barrie at the same time as the tenant is suing her clients for the agreement he had initially made with her on his behalf.
** Concerns of Howard Tavroges divulging client privileged information to Catherine Stewart had arisen when She used the information to contact the Orillia Community Legal clinic with threatening letters over alleged websites that were discussed with Tavroges in LTB in May 2013.
** Catherine Stewart also filed a civil lawsuit against the tenant over one of the alleged websites, without any documentation to prove who owned it.
A minimum fine of $25,000 and a year suspension if the tenants ULSC complaints are heard and Stewart found guilty of his claim.

C A Stewart and William Dykstra tell the attending Barrie police officers M Beard and Turner that Stewart had received an email from the Privacy Commissioner of Canada stating the tenant had contacted them and had vacated days before.
Stewart and William Dykstra could not produce the alleged email they claimed, they walked away when it was requested from the tenant.
** The tenant had earlier conversation that morning with C A Stewarts office to arrange the walk through and receive the last months rent.
** Dykstras and C A Stewart never had intentions of honoring the agreement they made on July 15th 2013 in LTB tribunal.
** Tenant files civil case SCC #1546-13 to retrieve owed funds from Dykstra Bros Electric.
** Be sure to read the follow up posts to the end of the civil hearings where Stewart and Dykstra Bros electric finally concede and pay the tenant the money owed from the Sean Henry LTB Order after many efforts and motions not to do so.
The tenant withdraws his CET #33911-13 application and includes the August 15th 2013 illegal entry and lock removal incident in his Human Rights applications against Catherine Stewart of Landlord legal and her clients Ralph Dykstra, William Dykstra and Don Dykstra of Dykstra Bros Electric.
Catherine Stewart filed two (2) civil cases in Barrie courts in November 2013, SCC #1851-13 & SCC #1852-13, against the tenant to attempt to have this website shut down or at the very least have the posts removed and claimed $5000 in property damages, although Catherine Stewart of Landlord legal made a call to the Barrie police under false pretenses and had Central lock & Key illegally enter the unit and the locks were removed and never replaced.
Catherine Stewart, of Landlord Legal inc soon learned that she was in the wrong court room to have this website shut down !
Stewart requested to withdraw her previous two (2) lawsuits when the tenant had asked for motions to be heard on the matter on May 27th 2014 and received permission to file a counter suit against Catherine Stewart and her clients Ralph Dykstra, William Dykstra, Don Dykstra of Dykstra Bros Electric.

We will continue to update all the past LTB hearings with the details, the pending Human Rights cases against Landlord Legal and her clients and the Upper Law Society complaints as they compiled.
The Conservative government’s plan to halt the growing of medical marijuana for personal use on March 31st 2014 and forcing patients to purchase their medical weed from Health Canada’s commercial growers had a setback Friday March 21st when a federal judge issued an injunction exempting anyone currently licensed to grow to continue past the deadline.
Judge Michael Manson issued an injunction exempting patients who are licensed to possess or grow medical marijuana under the current rules, either for themselves or for someone else, from new regulations that would have made the practice illegal.
A group of medical marihuana patients are represented by John Conroy,a BC lawyer behind a constitutional challenge and have asked for an injunction to preserve the status quo until their legal case goes to trial.
Under the terms of the injunction,patients who were licensed to grow marihuana as of September 30 2013 may continue to grow past the deadline that Health Canada had stated. Participants in the program are restricted to possessing 150 grams of dried marihuana which is the limit set by the new regulations the decision says. Health Canada had warned that any patients licensed to grow pot who didn’t confirm they had destroyed their plants would be reported to the police.
Health Canada had sent out letters last year to Medical Marihuana Access Program (MMAP) participants announcing the new proposed changes to the Medical Marihuana Access Regulations (MMAR) and inviting medical marihuana growers to apply for a commercial license.
Health Canada had also sent out letters with identifying information pertaining to the participants in the MMAP and their association with the Health Canada Medical Access Program and had sent the contact letters through regular mail services instead of private services that were always used for contact prior to the privacy breach. This is the third time Health canada has allegedly violated Federal Privacy Laws.

A trial on the constitutional argument has not been scheduled, though it is expected to take place within nine to twelve months.

A mediation date is set for March 2014 in superior court, but from past experiences dealing with Landlord Legal & the Dykstra’s in Landlord and Tenant Board with the already BAD MEDIATION attempt, we want this to go to into the courtroom to get final resolution on these matters. The Dykstra brothers properties have been in the Barrie news several times in the past for a drug bust at 24 Victoria Street, Barrie, Ontario when Manny P was raided by the Barrie Drug and Enforcement unit and arrested for having an illegal grow operation with approximately 80 plants in May 2011. Many police calls,approximately 8 reportable calls, since 2011 have been called to the 24 Victoria Street residence for various reasons.
The Dykstra’s brothers property at 40 Ellen Street, Barrie Ontario hit the front page in the Barrie Advance, a local newspaper,a few years back with clothes hanging from every available spot on the outside of the residence. I guess the resident at the time, Kara did not realize that Barrie has a clothes line by law which she did not adhere to causing complaints about the 80 year old house she rented looking like a slum shack and having local residents to complain to the city of Barrie about the matter.
